La présente Convention détermine la l o i applicable à la responsabilité découlant d'un dommage causé par un produit défectueux ou survenant en raison de propriétés latentes de ce produit, sauf lorsque le demandeur aura acquis le produit directement de la personne respon-sable.
Article 2
La responsabilité du fabricant est régie par la loi interne de l'Etat dans lequel se trouvait la résidence habituelle de la personne lésée directement par le produit, à moins qu'aucun produit de m ê m e origine et de m ê m e type que celui ayant causé le dommage ne soit, au moment de l'accident, vendu dans cet Etat avec le consentement ex-près ou implicite du fabricant.
Article 3
Si la condition posée à l'article 2 relative au consente-ment d o n n é par le fabricant à la vente de produits' simi-laires n'est pas remplie:
a la responsabilité du fabricant envers une personne directement lésée par le produit acquis par elle-même est régie par la l o i de l'Etat dans lequel ce produit a été acquis; toutefois, cette l o i ne s'applique que si des pro-duits de m ê m e origine et de m ê m e type que celui ayant causé le dommage étaient, au moment de l'accident, vendus dans cet Etat avec le consentement exprès ou i m -plicite du fabricant;
h la responsabilité d u fabricant envers une personne directement lésée par un produit qu'elle n'aura pas ac-quis elle-même est régie par la l o i de l'Etat sur le terri-toire duquel l'accident est survenu; toutefois, cette l o i ne s'applique que si des produits de m ê m e origine et de m ê m e type que celui ayant causé le dommage étaient, au moment de l'accident, vendus dans cet Etat avec le consentement exprès ou implicite du fabricant.
Article 4
Si la condition posée à l'article 3 a et 6 relative au consentement donné par le fabricant à la vente de pro-duits similaires n'est pas remplie, ou si l'Etat dans lequel le produit a été acquis, aux termes de l'article 3 a, ne peut être déterminé, la l o i applicable est la l o i du lieu de fabrication du produit.
Article 5
La l o i régissant la responsabilité du fabricant est aussi applicable à la responsabilité éventuelle de:

This Convention shall govern the law applicable to lia-bility i n cases when damage is causëd by defects or hidden properties présent in a product, w i t h the excep-tion of cases when the claimant acquired the product directly f r o m the person liable.
Article 2
The liability of a manufacturer shall be governed by the internai law of the country of the habituai résidence of the person directly injured by the product, unless i n that country at the time of the accident no products of the same origin and type as the product which caused dam-age were sold, with the express or implied approval of the manufacturer.
Article 3
I f the condition pertaining to the approved sale of similar products as stated i n article 2 is not f u l f i l l e d
-a the h-abiUty of -a m-anuf-acturer tow-ards -a person directly suffering damage who acquired the product h i m -self shall be governed by the law of the country i n which the product was acquired; this law, however, shall only apply i f , i n that country at the time of the accident, prod-ucts of the same origin and type as the product which caused damage were sold with the express or implied ap-proval of the manufacturer;
b the liability of a manufacturer towards a person directly suffering damage who did not acquire the pro-duct himself shall be governed by the law of the country in which the accident occurred; this law, however, shall only apply i f i n that country, at the time of.the accident, products of the same origin and type as the product which caused damage were sold w i t h the express or i m -plied approval of the manufacturer.
Article 4
If the condition pertaining to the approved sale of similar products i n article 3 a and b is not fulfilled, or the coun-try i n which the product was. acquired, referred to i n article 3 a, cannot be ascertained, the law of the place of manufacture of the product shall apply.
Article 5
The law governing the liability of the manufacturer shall also govern the liability, i f any, o f

Article 6

Article 7
La loi applicable selon la présente Convention déter-mine notamment:
1 la responsabilité du fait d'autrui, et spécialement celle du commettant:
2 les conditions et l'étendue de la responsabilité;
3 les causes d'exonération, ainsi que toute limitation et tout partage de responsabilité;
4 l'existence et la nature du dommage susceptible de réparation;
5 les modalités et l'étendue de la réparation;
6 la transmissibilité du droit à réparation;
7 les personnes ayant droit à réparation du dommage qu'elles ont personnellement subi;
8- [les recours entre personnes responsables et les sub-rogations;]
9 [le fardeau de la preuve;]
10 [les prescriptions et les déchéances f o n d é e s sur l'ex-piration d'un délai.]

The liability of a repairer f o r damage caused by parts he furnished i n the course of effecting repair shall be governed by the same law as i f the repairer were the manufacturer of a final product.
The liability of a repairer, who had also manufactured the product, f o r damage occasioned by the repair, shall be governed by the same law as i f the repaired object were a newly manufactured product.
Article 6
[Agreements made between a victim and a person liable designating the law applicable to cases of liability covered by article 1 shall be given effect.]
Article 7
The law deemed applicable under this Convention shall détermine i n
particular-1 vicarious liability, and especially the liability of a principal f o r the acts of his agents or of a master f o r the acts of his servant;
2 the basis and the extent of liability;
3 the grounds f o r exemption f r o m liability, any limit-ation of liability and any division of liability;
4 the existence and kinds of i n j u r y and damage which have to be compensated;
5 the kinds and the extent of damages;
6 the question whether a right to damages may be as-signed or inherited;
7 the persons who have suffered damage and who may claim damages i n their own right;
8 [recourse actions and subrogations;]
9 [the burden of proof ;]
10 [rules of prescription and limitation.]
