Divorce puts an end to the duty of support between spouses.
L’un des époux peut être tenu de verser à l’autre une prestation destinée à compenser, autant qu’il est possible, la disparité que la rupture du mariage crée dans les conditions de vie respectives.
One of the spouses may be compelled to pay the other an allowance intended to compensate, as far as possible, for the disparity that the breakdown of the marriage creates in the respective ways of living.
Cette prestation a un caractère forfaitaire. This allowance shall be in the nature of a lump sum.
Elle prend la forme d’un capital dont le montant est fixé par le juge.
It shall take the form of a capital the amount of which must be fixed by the judge.
Toutefois, le juge peut refuser d’accorder une telle prestation si l’équité le commande, soit en considération des critères prévus à l’article 271, soit lorsque le divorce est prononcé aux torts exclusifs de l’époux qui demande le bénéfice de cette prestation, au regard des circonstances particulières de la rupture.
However, the judge may refuse to grant such an allowance where equity so demands, either taking into account the criteria set out in Article 271, or when the divorce is declared on account of the blame lying wholly upon the spouse who requests the advantage of this allowance, considering the particular circumstances of the breakdown.

– l’âge et l’état de santé des époux ; - the ages and states of health of the spouses;
– leur qualification et leur situation professionnelles ;
- their professional qualifications and occupations;
– les conséquences des choix professionnels faits par l’un des époux pendant la vie commune pour l’éducation des enfants et du temps qu’il faudra encore y consacrer ou pour favoriser la carrière de son conjoint au détriment de la sienne ;
- the consequences of the professional choices made by one spouse during their living together for educating the children and the time which must still be devoted to this education, or for favoring his or her spouse's career to the detriment of his or her own;
– le patrimoine estimé ou prévisible des époux, tant en capital qu’en revenu, après la liquidation du régime matrimonial ;
- the estimated or foreseeable assets of the spouses, both in capital and income, after liquidation of the matrimonial regime;
– leurs droits existants et prévisibles ; - their existing and foreseeable rights;
– leur situation respective en matière de pensions de retraite en ayant estimé, autant qu’il est possible, la diminution des droits à retraite qui aura pu être causée, pour l’époux créancier de la prestation compensatoire, par les circonstances visées au sixième alinéa.

Dans le cadre de la fixation d’une prestation compensatoire, par le juge ou par les parties, ou à l’occasion d’une demande de révision, les parties fournissent au juge une déclaration certifiant sur l’honneur l’exactitude de leurs ressources, revenus, patrimoine et conditions de vie.
In the context of setting the amount of the compensatory allowance, by the judge or by the parties, or on the occasion of an application for revision, the parties shall provide the judge with declarations stating on their honor the accuracy of their resources, incomes, patrimony and living conditions.
Dans la détermination des besoins et des ressources, le juge ne prend pas en considération les sommes versées au titre de la réparation des accidents du travail et les sommes versées au titre du droit à compensation d’un handicap.
When determining the needs and resources, the judge shall not take into account to the sums paid as compensation for accidents in the workplace and the sums paid as an indemnity for a disability.

Le juge décide des modalités selon lesquelles s’exécutera la prestation compensatoire en capital parmi les formes suivantes :
The judge shall rule on the terms and conditions according to which a compensatory allowance in capital must be implemented according to the following forms:
1o Versement d’une somme d’argent, le prononcé du divorce pouvant être subordonné à la constitution des garanties prévues à l’article 277 ;
1° Payment of a sum of money, the declaration of divorce being made subject to the establishing of the guarantees provided for in Article 277;
2o Attribution de biens en propriété ou d’un droit temporaire ou viager d’usage, d’habitation ou d’usufruit, le jugement opérant cession forcée en

Lorsque le débiteur n’est pas en mesure de verser le capital dans les conditions prévues par l’article 274, le juge fixe les modalités de paiement du capital, dans la limite de huit années, sous forme de versements périodiques indexés selon les règles applicables aux pensions alimentaires.
Where a debtor is not able to pay the capital under the terms of Article 274, the judge shall fix the modes of payment of the capital, within the time limit of eight years, in the form of payments made at fixed intervals index-linked in accordance with the rules applicable to alimony payments.
Le débiteur peut demander la révision de ces modalités de paiement en cas de changement important de sa situation.
The debtor may request a revision of those modes of payment in case of an important change in his or her situation.
A titre exceptionnel, le juge peut alors, par décision spéciale et motivée, autoriser le versement du capital sur une durée totale supérieure à huit ans.
By way of exception the judge may then, by a special judgment setting out the grounds on which it is based, authorize the payment of the capital over a total period of longer than eight years.
Le débiteur peut se libérer à tout moment du solde du capital indexé.
The debtor may at any time pay off the balance of the index-linked capital.
Après la liquidation du régime matrimonial, le créancier de la prestation compensatoire peut saisir le juge d’une demande en paiement du solde du capital indexé.
After liquidation of the matrimonial regime, the creditor of a compensatory prestation may refer to the judge a claim for payment of the balance of the index-linked capital.
Article 275-1 Article 275-1
Les modalités de versement prévues au premier alinéa de l’article 275 ne sont pas exclusives du versement d’une partie du capital dans les formes prévues par l’article 274.
The modes of payment provided for in Article 275, paragraph 1, are not exclusive of the payment of part of the capital in the forms provided for in Article 274.

A titre exceptionnel, le juge peut, par décision spécialement motivée, lorsque l’âge ou l’état de santé du créancier ne lui permet pas de subvenir à ses besoins, fixer la prestation compensatoire sous forme de rente viagère.
By way of exception, when the age or state of health of the creditor does not allow him or her to supply to his or her needs, the judge may, by a judgment specifically outlining the grounds on which it is based, fix the compensatory allowance under the form of a life annuity.
Il prend en considération les éléments d’appréciation prévus à l’article 271.
He shall have regard to the factors laid down in Article 271.

A compensatory prestation set under the form of an annuity may be revised, suspended or suppressed in case of an important change in the resources or needs of either party.
La révision ne peut avoir pour effet de porter la rente à un montant supérieur à celui fixé initialement par le juge.
Revision may not lead to increase the annuity up to an amount superior to the one initially fixed by the judge.

Le débiteur d’une prestation compensatoire sous forme de rente peut, à tout moment, saisir le juge d’une demande de substitution d’un capital à tout ou partie de la rente.
The debtor of a compensatory allowance in the form of an annuity may at any time submit to the judge an application for replacing all or part of the annuity by a capital.
La substitution s’effectue selon des modalités fixées par décret en Conseil d’Etat.
The replacement must be effected according to terms established by decree en Conseil d’État.
Le créancier de la prestation compensatoire peut former la même demande s’il établit qu’une modification de la situation du débiteur permet cette substitution, notamment lors de la liquidation du régime matrimonial.
The creditor of a compensatory allowance may submit the same application where he or she establishes that a modification in the situation of the debtor allows that replacement, in particular at the time of liquidation of the matrimonial regime.
Les modalités d’exécution prévues aux articles 274, 275 et 275-1 sont applicables.
The terms and conditions of implementation provided for in Articles 274, 275 and 275-1 shall apply.

Indépendamment de l’hypothèque légale ou judiciaire, le juge peut imposer à l’époux débiteur de constituer un gage, de donner caution ou de souscrire un contrat garantissant le paiement de la rente ou du capital.
Irrespective of the legal or judicial hypothec, the judge may order the debtor spouse to create a pledge, to provide a surety or to enter into a contract that guarantees the payment of the annuity or capital.

En cas de divorce par consentement mutuel, les époux fixent le montant et les modalités de la prestation compensatoire dans la convention qu’ils soumettent à l’homologation du juge.
In case of divorce by mutual consent, the spouses shall fix the amount and terms and conditions of the compensatory allowance in the agreement which they submit to the judge for approval.
Ils peuvent prévoir que le versement de la prestation cessera à compter de la réalisation d’un événement déterminé.
They may contemplate that the payment of the prestation will come to an end from the occurrence of a specific event.

Les époux ont néanmoins la faculté de prévoir dans leur convention que chacun d’eux pourra, en cas de changement important dans les ressources ou les besoins de l’une ou l’autre des parties, demander au juge de réviser la prestation compensatoire.
Spouses have nevertheless the right to contemplate in their agreement that each of them may, in case of an important change in the resources or needs of either party, request the judge to revise the compensatory allowance.
Les dispositions prévues aux deuxième et troisième alinéas de l’article 275 ainsi qu’aux articles 276-3 et 276-4 sont également applicables, selon que la prestation compensatoire prend la forme d’un capital ou d’une rente temporaire ou viagère.
The provisions of Article 275, paragraphs 2 and 3, and of Articles 276-3 and 276-4 shall also apply, depending on whether the compensatory allowance takes the form of a capital or of a temporary or life annuity.

When, pursuant to Article 268, the spouses submit for approval by the judge an agreement relating to a compensatory prestation, the provisions of Articles 278 and 279 shall apply.

A la mort de l’époux débiteur, le paiement de la prestation compensatoire, quelle que soit sa forme, est prélevé sur la succession.
On the death of a debtor spouse, payment of a compensatory prestation, whatever its form may be, is deducted from the succession.
Le paiement est supporté par tous les héritiers, qui n’y sont pas tenus personnellement, dans la limite de l’actif successoral et, en cas d’insuffisance, par tous les légataires particuliers, proportionnellement à leur émolument, sous réserve de l’application de l’article 927.
The payment is borne by all the heirs, who may not be liable for it personally, within the limit of the assets of the succession, and in case they are insufficient, by all the specific legatees, in proportion to the advantage they received, subject to the provisions of Article 927.
