AGREEMENT BEHTEEN THE V/ORLD HEALTH ORGANIZATION 漏 THE PAN AMERICAN SANITARY BUREAU CONCERNING THE ADMISSION OF SH\FF OF THE PAN AMERICAN SANITARY BUREAU INTO THE UNITED NATIONS JOINT STAFF '

PENSION FUND

WHEREAS Article 2 of the Agreement between the World Health Organization and the Pan American Sanitary Organization, signed at Washington on 24 M a y 1949, provides that the Pan American Sanitary Bureau shall serve as the Regional Office for the Western Hemisphere, within the provisions of the Constitution of the World Health Organization; and

WHEREAS the Executive Committee of the Pan American Sanitary Organization at its meeting held from 20 to 23 September

1950,

resolved that there be presented to the United Nations Joint Staff Pension Board a request for the admission of staff members of the Pan American Sanitary Bureau to the United Nations Joint Staff Pension Fund, and also authorized the Director of the Pan Anerican Sanitary ‘ Bureau to consummate any agreements which may be required in order to enter said Pension Plan; and

IHEREAS the United Nations Joint Staff Pension Board, at its first session held from 16 to 25 October 1950, noted that the staff of the Pan American Sanitary Bureau serves as the Regional Office of the 頁orld Health Organization in the Americas and that the World Health Organization considers this staff as eligible for admission to the Fund under Article 2 of the Regulations ; and IHEREAS the said Board stated that it had no objection to the admission of the staff of the Pan American Sanitary Bureau as participants; and

IHEBEAS the Executive Board of the World Health Organization at its seventh session, authorized the Director-General to conclude an agreement for this purpose•

NOW THEREFORE

The World Health Organization (hereinafter referred to as "liHO") of the one part

and

The Pan American Sanitary Bureau (hereinafter referred to as "PASB") of the other part,

E W E AGREED A S FOLLŒÏS

Article I Admission of Staff

1» With effect from 1 January 1951 full time members of the Staff o;: the P A S B , serving as the Regional Office for the Americas of W H O , shall be eligible for admission into the United Nations Joint Staff Pension Fund (hereinafter referred to as "the Fund") on the same conditions as staff members of W H O , w i t h the

exception that certain staff members, participants :'.,n the Pension Fund of the Organization of American States m a y be excluded from such participation at the time of entry into force of this Agreement by common agreement between the Parties hereto.

2 . Contributory service for the purposes of the Regulations of the Fund shall commence for such staff members from the date of admission, provided that in the case of staff members purchasing contributory s ervice under the provisions of Article 3 of the said Regulations, the earliest date from which such contributory

service maybe purchased shall be 1 January 1951.

On the initial entry of its staff members into the Fund PASB shall provide to 1Ш0 the following documentation and information:

(a) Two copies of the Entrants Declaration Form (UN/РДЗЗя) duly completed in respect of each such staff members;

(b) Two copies of the History Record Card (UN/P/1336) duly completed in respect of each such staff member?

(c) A schedule in triplicate giving in respect of each such s taff member, name, s e x , date of birth, salary paid from 1 January 1951 to the end of the month immediately preceding the date of entry into force of this agreement, the amount of the staff members1

contribution to the Fund (7%)9 PASB!s contribution (14)多 and the total amount.

2, Thereafter PA SB shall provide to WHO documentation and information at such regular intervals and in such manner as may be determined from time to time by the Parties hereto•

Article III Medical Procedures

1 . The results of the medical examination of PASB participants in the Fund shall be forwarded to the WHO medical consultant in Geneva.

2. Henceforth, in conducting medical examinations for pension purposes, PASB agrees that such examinations shall be carried out by a physician approved b y the WHO medical consultant and following the medical standards adopted by the United

Nations Joint Staff Pension Board. PASB staff w h o have already been medically examined for employment purposes on or after 1 January 1950 shall not bereqiired to be re-examined provided that in the opinion of the medical consultant of "Ш0 the examination was carried out in substantial conformity with the requirements adopted by the United Nations Joint Staff Pension Board.

Article IV

Processing of Benefits

INhen a PASB staff member becomes entitled to a benefit, or in the case of a disability benefit is likely to become so entitled, PASB shall duly notify Ш 09

and shall supply any information required under the Administrative Rules of the Fund for the processing of the benefit。

Article V Contributions

1 . Upon the entry into force of this Agreement РАБВ shall make available to WHO for Payment into the Fund its own and the participants contributions as provided Articles 16 and 17 (a) of the Regulations of the Fund for the period

the date of entry into force of this Agreement.

2 , Thereafter PASB shall make available monthly to WHO its ovn and the participants contributions for that month,

5 . PASB shall similarly make available to WHO such sums as may be required under Article 17 (b) of the Eegulations of the Fund to maintain the Fund in a position to meet the obligations in respect of participants to whom the provisions of Article 3 of the Eegulations of the Fund apply.

Article Y I Deficiency Payments

Should WHO be called upon to make good any deficiency shovn by actuarial

Article VII Other Payments

M S B hereby agrees to make available to W H O; if appropriate in a proportionate share, any payments, contributions or expenses other than those provided for in Article V and V I of this Agreement payable under the Eegulations of the F u n d .

Article VIII Default by WHO

Should WHO Ъе declarea in default Ъу the United Nations Joint Staff Pension Board, staff members of PASB participating in the Fund shall be treated under the same conditions as staff members of WHO; in accordance vith Article 8 of the

Agreement for the admission of the World Health Organization into the United Nations Joint Staff Pension Fund_» provided that if PASB is nevertheless in a position to eontinue the payment of contributions in respect of its own staff members WHO shall make every endeavour to maintain the pension rights of those staff members under the Regulations of the Fund.

Article IX Default Ъу PASB

Should PASB for any reason interrupt or cease to make its payments under this Agreement, WHO and PASB shall immediately consult together concerning such

interruption or cessation of payments. In the event that PASB is unable to resume payments^ the Parties shall take such action as may be required to

terminate the participation of PASB staff members in the fund, provided that if PASB should later be in a position to resume payments, the Parties shall consult

concerning the re-admission of staff members of PASB into the fund.

Article X

Staff Regulations and. Bules

PASB hereby agrees to recommend to the appropriate organs of the Pan American Sanitary Organization the incorporation into the PASB Staff Régulations and Rules the provisions of the WHO Staff Regulations and Bules relating to pensions insofar as they may Ъе applicable and similarly to recommend to the said bodies the

incorporation of any amendments made thereto and confirmed by the World Health Assembly or the Executive Board.

Article XI

Regulations of the Fund

PASB hereby agrees to be bound by the Regulations of the Fund, the Administrative Bules of the Fund, and except as herein provided by the provisions of the Agreement for the admission of the World Health Organization into the United Nations Joint Staff Pension ïund and by any interpretation placed thereon or amendment made thereto by the bodies authorized to make such interpretation or amendment.

î Article XII

Mutual Consultation and Amendment

1 . WHO and PASB agree to consult together on any question concerning the interpretation or application of this Agreement,

2 . Either Party may at any time request the amendment of this Agreement in which case both the Parties shall consult together concerning the amendments to Ъе made.

Article XIII Entry into Force

This Agreement shall enter into force upon signature by the Director-General of the World Health Organization and by the Director of the Pan Ameriean Sanitary Organization.
