The twenty -third session of the Executive Board was convened in accordance with resolution EB22.R8, adopted by the Board at its twenty- second session.

In accordance with the instructions of the Board, the minutes of the Board and those of its Standing Committee on Administration and Finance have been sent in mimeographed form to Member governments.

in order to facilitate the use of the volume in conjunction with the Handbook of Resolutions and Decisions, they have been grouped by title in the table of contents under the subject- headings of the Handbook. There has also been added, beneath each resolution, a reference to the section of the Handbook containing previous resolutions on the same subject. The fourth edition of the Handbook -which is indexed both by subject and by resolution symbol- contains most of the resolutions adopted up to and including the Tenth World Health Assembly and the twentieth session of the Executive Board.

The twenty -third session of the Executive Board was held in the Palais des Nations, Geneva, from 20 January to 3 February 1959, under the chairmanship of Dr P. E. Moore, with Dr A.

Habernoll and Dr C. Diaz- Coller as Vice -Chairmen. Dr Jaswant Singh and Dr M. Slim were elected Rapporteurs. The list of members and other participants is given in Annex 1 and the membership of committees and working parties in Annex 2.

At this session (the agenda for which appears on page 1), the Board adopted the resolutions contained in this volume.

The Standing Committee on Administration and Finance,l in the course of thirteen meetings, beginning on 13 January, considered the items falling within its terms of reference as laid down by resolutions EB16.R12 and EB21.R44. The report of the Board on these items, in- corporating the examination and recommendations of the Standing Committee as well as the Board's own examination and recommendations, is published separately as Official Records No. 92. The Standing Committee's report on two additional items referred to it by the Board

during the session is reproduced in the present volume as Annex 28.

The Standing Committee on Non -governmental Organizations 2 held two meetings, at which it considered new applications from organizations for admission to official relations.

Its report will be found in Annex 3.

Having considered the situation of the pensioners of the OIHP in relation to that of persons receiving pensions from the United Nations Joint Staff Pension Fund, and having regard particularly to recent improvements in the pensions of the latter; and

Believing that the World Health Organization, as the successor organization to the OIHP, has a moral responsibility to ameliorate the situation of the OIHP pensioners with regard to the increase in cost of living in a manner consistent with that approved by the General Assembly of the United Nations for pensioners of the United Nations Joint Staff Pension. Fund,

REQUESTS the Director - General to complete his study of this matter and, on the basis of his findings, to provide, as from 1 February 1959, such supplemental payments to these pensioners as will accord to them an adjustment, related to cost of living increases, similar to that recently granted to pensioners

of the United Nations Joint Staff Pension Fund.

EB23.R25 Secondment of Staff from Member States The Executive Board,

Having considered the study made by the Director - General on the subject of secondment of staff to the Organization by Member States, as well as the occasional short -term secondment of a staff member from the Organization to a government;

Noting that provision for the latter exists in the WHO Staff Rule governing leave of absence and in the regulations of the United Nations Joint Staff Pension Fund; and

Noting, however, that satisfactory national legislation regarding secondments to the Organization does not in many cases exist,

I. AGREES with the principles for such secondments suggested by the Director -General;

2. CONSIDERS that the following minimum conditions appear necessary to facilitate the secondment to the Organization of the national official concerned :

(a) he should be assured of his acquired seniority in his own service during the whole of the period of secondment;

(b) he should have the assurance of being able to return to a post at least equivalent to the one he occupied before his secondment; with total emoluments at least equal to those he would normally be receiving had he not been seconded;

(c) he should keep his acquired rights towards a pension;

(d) he should be enabled either to continue his affiliation to the national pension fund, or have the possibility of validating his period of secondment on his return from secondment;

3. CONSIDERS further that, apart from these basic conditions, the preservation of certain other benefits such as social security, leave entitlements, etc., might also be considered;

4. REQUESTS the Director -General to prepare on the basis of these considerations a document containing the principles which should govern secondment of national officials to the Organization, together with appropriate observations, and to circulate this document to Member States of the Organization, inviting their comments thereon;

5. RECOMMENDS that all Member States of the Organization which have not already done so include in their national legislation the necessary provisions regarding the secondment of their officials to inter- national organizations, including the World Health Organization; and

6. REQUESTS the Director -General to transmit this resolution to the Secretary -General of the United Nations and the executive heads of the other specialized agencies for any appropriate consideration by the governing bodies of those organizations.

EB23.R46 Amendments to the Rules of Procedure of the World Health Assembly The Executive Board,

Having examined the suggestions put forward by the Director -General,

RECOMMENDS to the Twelfth World Health Assembly the adoption of the following resolution : The Twelfth World Health Assembly

ADOPTS the following amendments to its Rules of Procedure : 1

Rule 33

The main Committees of the Health Assembly [shall establish at each session] shall be : (a) the Committee on Programme and Budget;

(b) the Committee on Administration, Finance and Legal Matters.

In addition to these two main committees, the Health Assembly may establish such other main Committees as it may consider necessary; [and]

The Health Assembly, after consideration of the recommendations of the Board and the General Committee, shall allocate to such main committees appropriate items on the agenda.

The Chairman of these main committees shall be elected by the Health Assembly after consideration of the report of the Committee on Nominations.

Rule 62

When an amendment to a proposal is moved, the amendment shall be voted on first. When two or more amendments to a proposal are moved, the Health Assembly shall first vote on the amendment deemed by the President to be furthest removed in substance from the original proposal, and then on the amendment next removed therefrom, and so on, until all the amend- ments have been put to the vote. If one or more amendments are adopted, the amended proposal shall then be voted upon. such an amendment shall be deemed to be an integral part ofthe original proposal and no separate vote shall be required thereon. A motion is considered an amendment to a proposal if it merely adds to, deletes from or revises part of that proposal. A motion which constitutes a substitution for a proposal shall be considered as a proposal.

Rule 65

When a proposal has been adopted or rejected, it may not be reconsidered at the same session unless the Health Assembly, by a two- thirds majority of the Members present and voting, so decides. Permission to speak on a motion to reconsider shall be accorded only to two speakers opposing the motion, after which it shall immediately be put to a vote. The correction ofa clerical or arithmetical error in any document concerning a proposal which has already been adopted shall not be considered as requiring the reopening ofthe debate on such proposal by a two -thirds majority vote.

EB23.R48 Supply Services to Member States The Executive Board,

Having considered the basis on which supplies may be procured by the Organization on behalf of Member States as provided in resolution EB9.R90 and as modified by EB21.R38; and

Having reviewed a report of the Director - General on supply services to Member States,

DECIDES that the terms and conditions specified below shall apply to supply services to be provided by the Organization to Member States and Associate Members, to the United Nations and to specialized agencies and shall supersede the provisions of resolutions EB9.R90 and EB21.R38.

1. Non -emergency purchases for Member States

(a) WHO shall furnish procurement services only to agencies under the jurisdiction of the health administration or comparable authorities of the Member State or Associate Member, hereinafter referred to as the requesting authority.

(b) A charge of 3 per cent. shall be made for this service and shall be applied on the net cost of the items purchased, except that no charge for this service shall be applied where the purchases are being made in furtherance of an activity planned or carried out with the assistance of WHO.

(c) Before WHO makes commitments on behalf of a requesting authority, funds equal to the total cost as estimated by WHO shall be deposited in dollars (or in such other currencies as may be required

to effect the purchases) to the credit of WHO, in such a manner that WHO can draw freely upon the funds to make payments, including partial payments, as they become due. The necessary funds shall be provided either by cheque or bank draft payable on sight to WHO or by irrevocable documentary credit, payable

to WHO. If payment is by documentary credit, the credit must be payable on demand against a simple
