The forty -fifth session of the Executive Board was held at WHO headquarters, Geneva, from 20 to 29 January 1970, under the chairmanship of Sir William Refshauge, with Dr I. S. Kadama and Professor I. Moraru as Vice -Chairmen. The Rapporteurs were Dr H. M. El -Kadi and Dr M. El Kamal. The list of members and other participants, and the composition of the committees, will be found in Annex 1. The Board adopted the forty -four resolutions contained in this volume.

The Standing Committee on Administration and Finance, in the course of ten meetings beginning on 12 January, considered the items falling within its terms of reference as laid down by resolution EB16.R12. In addition to the Standing Committee's own members, a number of other members of the Board and their alternates and advisers attended its meetings in accordance with resolution EB44.R16. The Board's report on the proposed programme and budget estimates for 1971 and related matters is issued separately as Official Records No. 182.

Having examined the report by the Director -General on proposed joint action with the Food and Agriculture Organization of the United Nations in preparing methodology and criteria to be used in carrying out surveillance of zoonoses and evaluation of control programmes, requested in resolution WHA22.35 of the Twenty- second World Health Assembly,

1. NOTES that a small group of consultants will plan pilot studies to be carried out in selected areas; and

2. REQUESTS the Director -General to continue the proposed action in collaboration with FAO and to report to a future session of the Executive Board.

Having considered the report of the Director -General on the general programme of work for a specific period,3

RECOMMENDS to the Twenty -third World Health Assembly the adoption of the following resolution:

The Twenty -third World Health Assembly,

Having considered the implications, for the preparation of the 1972 annual programme of the Organization, of the transition from the fourth to a fifth general programme of work,

1. DECIDES to extend by one year the fourth general programme of work to include 1972; and

2. REQUESTS the Executive Board to proceed with the preparation of the fifth general programme of work and to submit to the Twenty- fourth World Health Assembly a proposed fifth general programme of work for the period 1973 -1977.

Considering the provisions of Article 52 of the WHO Constitution and Staff Regulation 4.5; and Considering the nomination and recommendation made by the Regional Committee for Africa at its nineteenth session,

1. REAPPOINTS Dr Alfred A. Quenum as Regional Director for Africa as from 1 February 1970; and 2. AUTHORIZES the Director -General to extend the appointment of Dr Alfred A. Quenum as Regional Director for Africa for a period of five years from 1 February 1970, subject to the provisions of the Staff

Regulations and Staff Rules.

EB45.R18 Review of the Working Capital Fund The Executive Board,

Recalling the provisions of resolution WHA18.14;

Having studied the report by the Director -General on the Working Capital Fund;l

Recalling that the Executive Board in its resolution EB41.R40 considered that the recommendations numbered 16, 17, 18, 19, 20 and 22 of the Ad Hoc Committee of Experts to Examine the Finances of the United Nations and the Specialized Agencies, dealing with matters relating to the Working Capital Fund, were already in operation in WHO;

Recalling further that the Board in the same resolution decided " because it could lessen the control exercised by the Health Assembly and the Executive Board on the obligations incurred by the Organization, not to introduce a separate appropriation section for contingencies ";

Having considered recommendation 21 of the Ad Hoc Committee to the effect that " the practice whereby some organizations credit all or part of their miscellaneous income to their Working Capital Fund should be discontinued; miscellaneous income should be paid into the general fund ".2

Conscious of the need to follow as far as may be practicable the recommendations of the Ad Hoc Com- mittee of Experts to Examine the Finances of the United Nations and the Specialized Agencies; and

Believing that prudent financial management requires that the size of the Working Capital Fund be considered in relation to the level of the annual effective working budget of the Organization,

1. CONSIDERS that it is in the best interest of the Organization to continue to finance a part of the Working Capital Fund from casual income available to the Organization, rather than by additional assessments on Members;

2. AGREES that the amount which may be advanced, with the prior concurrence of the Executive Board, from the Working Capital Fund to meet unforeseen or extraordinary expenses should be increased to US $2 000 000;

3. CONSIDERS that the Working Capital Fund should be reviewed annually by the Board and the Health Assembly; and

4. RECOMMENDS to the Twenty -third World Health Assembly the adoption of the following resolution:

The Twenty -third World Health Assembly,

Having considered the recommendations of the Executive Board on the Working Capital Fund, A

1. DECIDES that:

(1) Part I of the Working Capital Fund, composed of advances assessed on Members, shall remain established in the amount of US $5 000 000, to which shall be added the assessments of any Members joining the Organization after 30 April 1965;

(2) the advances to the Working Capital Fund shall be assessed on the basis of the 1971 scale of assessment, adjusted to the nearest US $100; the assessment for Part I shall be reviewed at five -year intervals;

(3) the additional advances shall be due and payable prior to 31 December 1971; and

(4) the credits due to Members shall be refunded on 1 January 1971 by applying these credits to any contributions outstanding on that date, or to the 1971 assessments;

2. REQUESTS the Member States concerned to provide in their national budgets for payment of additional advances before 31 December 1971;

1. DECIDES that Part II of the Working Capital Fund shall for the year 1971 be established at US $6 000 000;

2. DECIDES also that Part II of the Working Capital Fund shall thereafter be financed by appropriations . by the Health Assembly from casual income as recommended by the Executive Board after considering the report of the Director -General; these appropriations shall be voted separately from the appropriation for the relevant budget year;

1. AUTHORIZES the Director- General to advance from the Working Capital Fund:

(1) such funds as may be necessary to finance the annual appropriations pending receipt of contri- butions from Members; sums so advanced shall be reimbursed to the Working Capital Fund as contributions become available;

(2) such sums as may be necessary to meet unforeseen or extraordinary expenses and to increase the relevant appropriation sections accordingly, provided that not more than US $250 000 is used for such purposes, except that with the prior concurrence of the Executive Board a. total of US $2 000 000 may be used; and

(3) such sums as may be necessary for the provision of emergency supplies to Member States on a reimbursable basis; sums so advanced shall be reimbursed to the Working Capital Fund when payments are received from the Member States; provided that the total amount so withdrawn shall not exceed US $100 000 at any one time, and provided further that the credit extended to any one Member shall not exceed US $25 000 at any one time; and

2. REQUESTS the Director -General to report annually to the Health Assembly:

(1) all advances made under the authority vested in him to meet unforeseen or extraordinary expenses and the circumstances relating thereto, and to make provision in the estimates for the reimbursement of the Working Capital Fund except when such advances are recoverable from other sources; and

(2) all advances made under the authority of paragraph C 1 (3) for the provision of emergency supplies to Member States, together with the status of reimbursement by Members;

REQUESTS the Executive Board to review the Working Capital Fund at its first session in 1971 and to submit a report to the Health Assembly.

1. DECIDES that:

(i) a new Real Estate Fund be established and the Revolving Fund for Real Estate Operations be disestablished;

(ii) the assets and liabilities of the disestablished Revolving Fund for Real Estate Operations be transferred to the Real Estate Fund;

(iii) the Real Estate Fund be credited with receipts of rentals relating to real estate operations and that additional credits in the Fund be built up gradually by the use of available casual income;

(iv) interest earned on the investments of the Fund be credited to the Fund;

(v) the Fund may be used to meet the costs of:

(a) the maintenance, repairs of and alterations to houses for staff;

(b) major repairs of and alterations to the Organization's existing office buildings;

(c) the construction of buildings or extensions to existing buildings; and (d) the acquisition of land which may be required;

2. DECIDES that replenishments of, or increases in, the Fund shall be made by appropriations by the Health Assembly from casual income; these appropriations shall be voted separately from the appro- priation for the relevant budget year;

3. AUTHORIZES further the Director -General to use the Fund to finance:

(i) the maintenance, repairs of and alterations to houses for staff;

(ii) major repairs of and alterations to the Organization's existing office buildings, provided that such use of the Fund is reported to the session of the Executive Board following the transactions;

and

(iii) the acquisition of land and construction of buildings or building extensions, provided that, unless the Health Assembly has previously indicated its wishes, specific authorization from the World Health Assembly is obtained before contracts for these purposes are entered into;

4. REQUESTS the Executive Board to review the Fund at three -year intervals, the first review to be under- taken at its first session in 1973.

Having considered the report of the Director -General on the smallpox eradication programme;

Having noted that significant progress is being made in the eradication effort in most parts of the world and, particularly, in countries of western and central Africa which have virtually succeeded in interrupting smallpox transmission after only three years;

Believing that the progress in the programme to date calls for renewed efforts on the part of all countries and that the programme should continue to be one of the principal objectives of the Organization;

Viewing with concern that a few endemic countries have still not initiated programmes and that not all are yet using freeze -dried vaccine conforming to recommended standards; and

Noting the importance of surveillance in present programmes and the desirability, at this time, of placing a much greater emphasis on the detection, investigation and containment of all cases and outbreaks in all countries,

1. REQUESTS

(1) all countries to take appropriate steps to improve further case -reporting and to adopt as an objective the immediate investigation and containment of all reported cases and outbreaks of smallpox from

1970 onwards; and

(2) all countries to provide continued support to the programme, including vaccine and other assistance;

and

2. REITERATES the importance of using in the eradication programme only freeze -dried vaccine which meets the requirements established by WHO;

3. REQUESTS the Director -General:

(1) to contact those endemic countries that are not yet conducting eradication programmes to determine what assistance might be required to permit them to undertake such efforts;

(2) to continue to take all necessary steps to assure the maximum co- ordination of national and inter- national efforts; and

(3) to report further on the progress of the smallpox eradication programme to the World Health Assembly and to the Executive Board.

Having considered a request from the Government of the People's Republic of Southern Yemen for a reduction of its contribution for the year 1970;

Recalling that the World Health Assembly, in resolution WHA22.6, reduced the contribution of Southern Yemen for 1968, its first year of membership, and, in resolutions WHA21.11 and WHA22.7, established its contribution at 0.04 per cent. for 1969 and 1970;

Recalling also that, in accordance with resolution WHA8.5, " the World Health Assembly in its previous sessions has expressed the opinion that the United Nations scale should be used as a basis of determining the scale of assessment to be used by WHO, taking accóunt of (a) the difference in membership; and (b) the establishment of minima and maxima, including the provision that no country shall be required to pay more per capita than the per capita contribution of the highest contributor "; and

Considering further that the General Assembly of the United Nations, in resolution 2190 A (XXI), recommended that the specialized agencies which apply methods of assessment similar to those of the United Nations and whose scales of contributions still differ appreciably from the United Nations scale take steps to bring their scales into harmony with the United Nations scale as soon as possible,

1. DECIDES that the request of the Government of the People's Republic of Southern Yemen must be dealt with by the Health Assembly;

2. REQUESTS the Director -General to invite the Government of the People's Republic of Southern Yemen to submit any additional information it wishes to be brought before the Health Assembly and to submit to the Health Assembly such information together with the summary record of the discussion of this matter in the Executive Board and the document which the Board had before it when it considered the request; and

3. SUBMITS the request to the Twenty -third World Health Assembly for its consideration.

Noting that, unless payments are received before the Twenty -third World Health Assembly, convened for 5 May 1970, from Bolivia, the Dominican Republic, Ecuador, El Salvador, Haiti, Paraguay, Peru, Sudan

and Uruguay, it will be necessary for the Assembly to consider, in accordance with Article 7 of the Constitu- tion and the provisions of paragraph 2 of resolution WHA8.13, whether or not their right to vote should be suspended at the Twenty -third World Health Assembly;

Noting also that the Associate Member Southern Rhodesia is also in arrears for more than two years;

Recalling that resolution WHA16.20 requests the Executive Board " to make specific recommendations, with the reasons therefor, to the Health Assembly with regard to any Members in arrears in the payment of contributions to the Organization to an extent which would invoke the provisions of Article 7 of the Constitution ";

Noting that Bolivia and Haiti have not fulfilled the conditions accepted by the World Health Assembly;

that partial payments have been made by Ecuador and Uruguay; and

Expressing the hope that Members in arrears will arrange for payment of their arrears before the Twenty - third World Health Assembly, so that the provisions of Article 7 of the Constitution need not be invoked by the Health Assembly,

1. URGES all the Members concerned to arrange payment of their arrears before the Twenty -third World Health Assembly convened for 5 May 1970;

2. URGES Bolivia and Haiti to fulfil the conditions previously accepted by the World Health Assembly for the settlement of their arrears;

3. REQUESTS the Director- General to communicate this resolution to those Members and to continue his efforts to obtain payment of their outstanding arrears;

4. REQUESTS the Director -General to submit a report on the status of contributions from those Members .to the Ad Hoc Committee of the Executive Board which is to meet prior to the discussion on arrears in

contributions by the Twenty -third World Health Assembly; and

5. REQUESTS the Ad Hoc Committee to consider all the circumstances involving those Members which, at the time of its meeting, remain in arrears in the payment of their contributions to an extent which may invoke Article 7 of the Constitution, and to submit to the Twenty -third World Health Assembly on behalf of the Board such recommendations as it deems desirable.

1. NOTES with satisfaction the positive results attained by the pilot project;

2. RECOMMENDS to the Twenty -third World Health Assembly that the activities.of the project be developed into a primary operational phase, as a further step towards a fully operational system of monitoring adverse reactions to drugs and as an integral part of the programme of the Organization;

3. EXPRESSES the hope that, pending a decision on the subject by the World Health Assembly, ways and means will be found to finance the activities of the project in 1970, after the funds available from the grant under which it operates have been exhausted;

4. CALLS the attention of the Twenty -third World Health Assembly to the need for ensuring the further financing of the activities in question as from 1971, should it be decided that they would be pursued as pro- posed under paragraph 2 of this resolution;

5. REQUESTS the Director -General to report to the World Health Assembly on any possibility he can identify of making savings within the budget estimates for 1971 to meet this cost, after having examined the possibility of reducing the estimated cost of the project;

Having examined in detail the proposed programme and budget estimates for 1971 submitted by the Director -General in accordance with the provisions of Article 55 of the Constitution, and

Considering the comments and recommendations on the proposals made by the Standing Committee on Administration and Finance,

1. TRANSMITS to the Twenty -third World Health Assembly the programme and budget estimates as proposed by the Director -General for 1971,' together with its comments and recommendations;a and

2. RECOMMENDS to the Health Assembly that it approve an effective working budget for 1971 of $73 230 000.

EB45.R28 Method of Work of the Health Assembly The Executive Board,

Having considered the report of the Director -General on the method of work of the Health Assembly;3 Recalling resolutions EB16.R3, WHA10.33, WHA20.2 and EB43.R45; and

Considering that it might be appropriate to establish two main committees, identified as Committee A and Committee B- Committee A dealing preponderantly with programme and budget matters, and the other preponderantly with administration, finance and legal matters, but with allocation of agenda items to each in such a way that the workload would be equitably distributed -and that, in consequence, the arrangements contained in resolution WHA20.3 should be revised,

RECOMMENDS to the Twenty -third World Health Assembly the adoption of the following resolution, to be put immediately into effect on an experimental basis:

The Twenty -third World Health Assembly,

Having considered the recommendation of the Executive Board concerning the method of work of the Health Assembly,

1. DECIDES that:

(1) the terms of reference of Committee A shall be to:

(a) hear the comments and recommendations of the Executive Board as presented by its representative concerning:

(i) whether the budget estimates are adequate to enable the World Health Organization to carry out its constitutional functions, in the light of the current stage of its development;

(íi) whether the annual programme follows the general programme of work approved by the Health Assembly;

(iii) whether the programme envisaged can be carried out during the budget year; and (iv) the broad financial implications of the budget estimates, with a general statement of the information on which any such considerations are based;

(b) hear the comments and recommendations of the Director -General;

(c) recommend the amount of the effective working budget;

(d) examine in detail the operating programme;

(e) recommend the Appropriation Resolution, after inserting the amounts in the sections for the operating programme in the text of the resolution as reported by Committee B;

(f) after the World Health Assembly has approved the Appropriation Resolution for the ensuing year, and after hearing the reviews of the Director -General, recommend the general order of magnitude for the budget for the second ensuing year, for the orientation of the Director -General in the preparation of his proposed programme and budget for that year; and (g) study such other items as are referred to it by the Health Assembly;

(2) the terms of reference of Committee B shall be to:

(a) review the financial position of the Organization, including:

(i) the Financial Report and the Report of the External Auditor for the previous financial year;

(ii) the status of contributions and advances to the Working Capital Fund;

(iii) the status of the Assembly Suspense Account and any other funds that have a bearing on the financial position of the Organization;

(b) recommend the scale of assessment;

(c) recommend the Working Capital Fund resolution, when necessary, including the amount in which the Fund shall be established;

(d) review the parts of the budget dealing with the estimates other than for the operating programme and report thereon to Committee A;

(e) consider the text of the Appropriation Resolution, insert the amount for appropriation sections other than the operating programme and report thereon to Committee A; and (f) study such other items as are referred to it by the Health Assembly;

(3) when items (a), (b), (c) and (f) under paragraph (1) are being considered in Committee A, there shall not be a meeting of Committee B, and when item (d) under paragraph (2) is being consi- dered in Committee B, there shall not be a meeting of Committee A;

(4) items (b) and (c) under paragraph (1) shall not be considered by Committee A until Committee B has completed the work on items (a) and (b) of paragraph (2); and finally,

(5) if, exceptionally, the physical facilities at a session of the Health Assembly do not permit the debate on the Annual Report of the Director -General to take place in plenary meeting, the review of the Annual Report (excluding the annual Financial Report) shall take place in Committee A and shall be added to the terms of reference of that committee;
