1. The Committee on Industrial Co-operation (hereinafter referred to as "the COlllllli.ttee"), shalllle the'Committee on Industrial CO-operation established by Article 11 of the TrelitY for the Establishment of the Preferential.Tx:ad" Area

for Eastern and Southern African States (hereinafter referred to as !.'the Treaty") • 2. The Commi ttee

3. It. shall be.the duty ()f the Committee to assist the Member States to prolll)te industrial development and co-operation within the Preferential Trade Area for Eastern and sOuthern African States (hereinafter referred to as; "the Preferential Trade Area"), in accordance with the provisions of the Protocol on Co-operation in the field of Industrial Development annexed to the Treaty as Annex VIII, by:

(a) the promotion .of collective self-reliance in the field of industry;

, (b) the promotion of multinationalcoJlq>lementarity in industrial development;

(c) the expanaLon of trade in indiiSh.lal products;

and'

(d) the provision of related training facilitiE!S within the Preferential Trade Ai-ea.

4. In the discharge of its funcj:ionsas set out in paragraph 3 of these Terms of Reference, the Committee shall'in particular:

promote the creation or strengthening as the case may"De, of

nat~c;ma~; ind~trialdevelopment in;stitutions of the Member States;

foster eo-operation between itself and the national industrial 'development institutions of the Member States;

5. I t shall be the function of the committee to assist the ~mber States; in

accordance with the provisions of the Protocol on Standardization and Quality Control annexed to the Treaty as Annex XI, to eVOlve a coneon policy with regard to the

standardization and quality control of goods originating in the Member States and to undertake such other activities in standardization as would promote trade within the Preferential Trade Area.

6. In the discharge of its functionR as set out in paragraph 5 of these Terms of Reference, the Committee shall in particular:

(a) study all questions relating to the standardization and quality control of go0ds within the Preferential Trade Area;

in close co-operation with the national institutions responsible 'for standardization and qaality control in the Member States,and

(c) make reconurendati.ons to the Council of Ministers of the Preferential Trade Area with respect to the implementation of the provision~ of Articles ,3~ 4, 5 'and 6 of the Protocol

on Standardization and Quality Control with respect to co-operation in standardization and,quality control,co-operation in training in standardization and'quality control: 'procedures, certificati.on, inspection and ~form evaluation with respect to standardization and quality contro~:andthe,labe1ling of goods.

7. The Committee shall:

implement such regUlations as may be made by the Council of Ministers of' the Preferential Trade Area in pursuance of the provisions of, the Protocol on Co-operation in the field of Industrial Development and the Protocol. on Standardization and Quality Control:

give effect to such directives as may .be given .toit. by the Council of Ministers from time to time,and

(c) perform such other func:tions as may be necessary for the

efficient implementation of the provisions of Articles 24 and"

27 of the Treaty and the Protocols referred to in sub-paragraph (a) of thiS,paragraph.

The COmmittee shall submit from time to time reports and recommendations to the IntergoverrtmentalComnti.ssion of Experts of the Preferential Trade Area either on its own initiative or upon the request of the comnti.'Ssion oz the COuncil of

Ministers of the PrEilferentia+ ,Trade Are,a concerning the implementation of the provisions of the Treaty referred to in these TermS of Reference and the Protocols referred to in these Terms of Reference.

9. These Terms of Reference shall be read in conjunction with the Treaty and the Protocols referred to in these Terms of Reference. 'The provisions of these TerJl'S of Reference On the'6ne hand and the provisions of the Treaty and the Protocols on the other hand shall be applicabie and neither shall narrow the effect of the other, but in any case of absolute conflict the provisions of the Treaty and the

Protocols shall prevail.
