The following list is an inventory of points for which one or more delegation do not share; the working document; It should simply be considered as a list for further discussion to be held in the WP Legislation 22-23 November 2005.
Type of legal act

Conservation Varieties
2. Distinctness: criteria other than a reduced number of characteristics should be considered.
3. State of Genetic Erosion: any references to Plant Genetic Resources Authorities should be deleted or amended.
4. Impediment to designate a variety as a Conservation Variety: the period after deletion from the National Catalogue should be longer.
5. Impediment to designate a variety as a Conservation Variety: the case of same varieties rejected in the procedure for admission to the National Catalogue should be covered.
6. Region of adaptation of a variety: addition of new regions after registration of the variety should be possible.
7. Field inspections of agricultural seed crops: it should not be required.
8. Official post-control of agricultural seed: it should be required.
9. Compliance with crop conditions for vegetable seed: it should not be required.
10. Seed testing by official checks of vegetable seed: it should be required.
11. Official label for seed potatoes: it should be required.
12. Marketing restrictions of seed/reproductive/planting material: no restrictions should be imposed.
