(248) ﺟﺮﯾﻤﺔ اﻹﺟﮭﺎض ـ دراﺳﺔ ﻣﻘﺎرﻧﺔ ﺑﯿﻦ اﻟﻘﺎﻧﻮن اﻟﻮﺿﻌﻲ واﻟﻔﻘﮫ اﻹﺳﻼﻣﻲ ﻣﻠﺨﺺ اﻟﻤﻮﺿﻮع. اﻹﺟﮭﺎض ﻇﺎھﺮة ﻋﺎﻟﻤﯿﺔ زاد اﻧﺘﺸﺎرھﺎ ﻟﻌﺪة دواﻓﻊ ،ﺣﯿﺚ ﻋﻘﺪت اﻟﻤﺆﺗﻤﺮات وﺗﻌﺎﻟﺖ اﻷﺻﻮات ,وأﻧﻔﻘﺖ اﻷﻣﻮال ﻣﻦ أﺟﻞ ﺗﺤﻘﯿﻖ ﻣﺸﺮوع إﺑﺎﺣﺔ اﻹﺟﮭﺎض ﻣﻦ ﺧﻼل ﺣﻤﻠﺔ ﻣﻦ أﻋﺪاء اﻹﺳﻼم ﺗﻨﺎدي ﺑﮫ ،ﻟﻠﻘﻀﺎء ﻋﻠﻰ اﻟﺤﻤﺎﯾﺔ اﻟﻘﺎﻧﻮﻧﯿﺔ واﻟﺸﺮﻋﯿﺔ ﻟﻠﺠﻨﯿﻦ ،رﻏﻢ أن اﻹﺳﻼم ﺣﺚ ﻋﻠﻰ ﺗﻜﺜﯿﺮ اﻟﻨﺴﻞ ﻟﺪﻋﻢ اﻷﻣﺔ ,ﻟﻘﻮﻟﮫ ﺻﻠﻰ اﷲ ﻋﻠﯿﮫ وﺳﻠﻢ "ﺗﻨﺎﻛﺤﻮا ﺗﻨﺎﺳﻠﻮا ,ﻓﺎﻧﻲ ﻣﺒﺎه ﺑﻜﻢ اﻷﻣﻢ ﯾﻮم اﻟﻘﯿﺎﻣﺔ" .ﻟﺬﻟﻚ ﻛﺎن وﻻﺑﺪ ﻣﻦ إﯾﻘﺎف ﻣﺜﻞ ھﺬه اﻟﺪﻋﺎﯾﺎت ﻟﻺﺟﮭﺎض ،ووﺿﻊ ﺿﻮاﺑﻂ وأﺣﻜﺎﻣﺎ أﺳﺎﺳﯿﺔ ﺗﺤﺪ ﻣﻦ ھﺬه اﻟﻈﺎھﺮة ﺗﻔﺎدﯾﺎ ﻣﻦ ﺗﻔﺸﻲ اﻟﻮﺑﺎء واﺗﺴﺎع رﻗﻌﺘﮫ ﻓﻲ أرﺟﺎء اﻟﻤﻌﻤﻮرة اﻟﻌﺮﺑﯿﺔ اﻹﺳﻼﻣﯿﺔ.ﺣﯿﺚ وﺿﻊ اﻟﻤﺸﺮع ﻧﺼﻮص ﻋﻘﺎﺑﯿﺔ اﻟﻐﺮض ﻣﻨﮭﺎ ﺗﺠﺮﯾﻢ ﻓﻌﻞ اﻹﺟﮭﺎض وﺗﻮﻓﯿﺮ ﺣﻤﺎﯾﺔ ﺟﺰاﺋﯿﺔ ﻟﻠﺠﻨﯿﻦ وھﻮ ﻓﻲ ﺑﻄﻦ أﻣﮫ ,وﺿﻤﺎن اﺳﺘﻤﺮارﯾﺔ ﻧﻤﻮه ﻧﻤﻮا ﻃﺒﯿﻌﯿﺎ ﺑﺎﻋﺘﺒﺎره ﻣﻘﺪﻣﺔ ﻹﻧﺴﺎن ﯾﺴﺘﺤﻖ ﺣﻘﻮﻗﺎ .ﺑﻤﺠﺮد وﻻدﺗﮫ ﺣﯿﺎ ﻣﻦ وﺻﯿﺔ ,وھﺒﺔ وإرث وأھﻢ ﺣﻖ ھﻮ ﺣﻘﮫ ﻓﻲ اﻟﺤﯿﺎة .ﻛﻤﺎ ﺣﺮﺻﺖ اﻟﺸﺮﯾﻌﺔ اﻹﺳﻼﻣﯿﺔ ﻋﻠﻰ ﺣﻤﺎﯾﺔ اﻟﺠﻨﯿﻦ ﺟﻨﺎﺋﯿﺎ ﻣﻨﺪ وﻗﻮع اﻟﻨﻄﻔﺔ ﻓﻲ اﻟﺮﺣﻢ إﺗﺒﺎﻋﺎ ﺑﻤﺮاﺣﻞ ﺗﺨﻠﻘﮭﺎ ,واﻋﺘﺒﺮت ﺣﻔﻆ اﻟﻨﺴﻞ ﻣﻦ اﻟﻜﻠﯿﺎت اﻟﺨﻤﺲ إذ ﺑﮫ ﺑﻘﺎء اﻟﻨﻮع ،وﻋﻤﺎرة اﻷرض ،وﻋﺒﺎدة اﷲ ﻋﺰ وﺟﻞ ,ﻟﺬﻟﻚ ﻧﮭﻰ اﷲ ﻋﻦ ﻗﺘﻞ اﻟﻨﻔﺲ ﺑﻐﯿﺮ وﺟﮫ ﺣﻖ ﻷي ﻋﺎرض ﻣﻦ ﻋﻮارض اﻟﺤﯿﺎة ,ﺳﻮاء ﺑﺈﻓﺴﺎد اﻟﺤﻤﻞ ﻗﺒﻞ اﻟﺘﺨﻠﯿﻖ أو ﻗﺘﻠﮭﺎ ﺑﻌﺪ اﻟﻮﻻدة ،وﻧﮭﻰ اﻟﺮﺳﻮل ﻋﻠﯿﮫ اﻟﺼﻼة واﻟﺴﻼم ﻋﻨﺪ ذﻟﻚ ،واﻋﺘﺒﺮ ﻗﺘﻞ اﻟﻨﻔﺲ ﻣﻦ اﻟﻜﺒﺎﺋﺮ .ﻛﻤﺎ ﺟﺎء ت ﺟﻤﯿﻊ اﻟﺸﺮاﺋﻊ اﻟﺴﻤﺎوﯾﺔ ﺑﺈﯾﺠﺎب ﺣﻔﻆ اﻟﻨﻔﻮس اﻟﺒﺸﺮﯾﺔ.. ﻛﻠﻤﺎت ﻣﻔﺘﺎﺣﯿﺔ: اﻟﺠﻨﯿﻦ؛ اﻻﻋﺘﺪاء؛ ﺟﺮﯾﻤﺔ؛ اﻟﺤﻖ؛ اﻟﺤﯿﺎة؛ اﻹﺟﮭﺎض؛ اﻷﻃﺒﺎء؛ اﻟﻌﻘﺎب؛ اﻟﻘﺎﻧﻮن؛ اﻟﺸﺮﯾﻌﺔ اﻹﺳﻼﻣﯿﺔ..
