Charter for the use of IT resources and Internet services

This text is a code of conduct. It aims to clarify the responsibility of users in accordance with the laws to

establish a correct use of computer resources and Internet services with minimal rules of courtesy and respect to others.

For further information, please contact the IT department of GATE Lyon St-Etienne laboratory.

The following instructions are intended :

 To inform users of their rights and duties for the use of computer resources

 To raise awareness on security issues

 To make them aware of the penalties provided for offenders

Application of Charter

This charter applies upon signature.

 The first access to the GATE Lyon St-Etienne network, and / or first use of computer or software belonging to the GATE Lyon St-Etienne must be preceded by the signing of the charter.

 Users agree to comply with the charter of security by signing a copy of it.

1. Definitions

Generally speaking, the following shall be designated as "computer resources": the networks, the computer means for calculating, storing, or local management equipment, and that which is able to be remotely accessed, either directly or in cascade mode from the entity's network, the software, applications, databases … administered by the GATE Lyon St- Etienne.

The following shall be designated as "Internet services": the provision by local or remote servers of sundry exchange and information resources: web, message application, forum, videoconferencing, …

"User" shall mean the person having access to, or using, the computer resources and Internet services no matter what his/her status may be.

2. Application and duration scope

This charter applies to every person working at GATE Lyon St-Etienne (CNRS and university staff, PhD students at GATE, trainees, guest members, ...), and more generally to all permanent or temporary people, using the computer resources of GATE Lyon St-Etienne and those which can be accessed, either directly or in cascade from the network administered by the GATE Lyon St-Etienne.

The right of access to the computer resources at GATE Lyon St-Etienne and Internet services can be issued only by the network administrator of the laboratory or a competent person. Moreover, this issue must be authorized by:

 The network administrator in the case of Fixed Term Access (FTA thereafter)

 The consulting laboratory in the case of Access Time Indefinite (ATI thereafter) This access is personal, not transferable and temporary.

Any user looses his/her right to use computer resources and Internet service at GATE Lyon St-Etienne when his/her status as a GATE Lyon St-Etienne member expires in the case of an FTA, or its access time expires in the case of an ATI. Users should report any change in their attachment to the GATE Lyon St-Etienne to the relevant services. In the case of a loss of access rights:

 The access logs are deleted (domain account and email)

 The IT department will keep for a period of 3 months in the case of ATI and 1 month in the case of FTA, the users' data on 1) the user's email account and 2) its directories storage on servers dedicated to that purpose.

After this period, the IT department reserves the right to delete such data without warning the user.

 File transfers and email forwarding may be considered during this period.

 Users' data stored on work computers (desktop and laptop) are not backup guaranteed and can be destroyed at any time without the user being informed.

This access may be withdrawn, temporarily or permanently, if the user behavior is at odds with the rules defined in the Charter. In the case of a definitive loss of access due to a serious fault, the agreement of the board of the laboratory is required. In the case of a definitive loss of access, the user permanently loses his right of access and conditions mentioned above apply.

3. Access to computer resources and Internet services

Use of computer resources and Internet services, and the network to access is only permitted under the exclusive occupation of users in accordance with current legislation.

The professional activity is ruled by GATE Lyon St-Etienne policy, namely: research, education, technical development, technology transfer, dissemination of scientific and technical experimentation with new services character of technical innovation, but also all administrative and management arising from or accompanying such activities.

Use of shared computing resources of GATE Lyon St-Etienne and the connection of a device on the network are also subject to authorization. These authorizations are strictly personal and can't in any case be transferred, even

temporarily, to a third party. These permissions may be withdrawn at any time. Any authorization expires at the same time as the professional activity that justified it.

The GATE Lyon St-Etienne may also provide access restrictions specific to its organization: (Smartcard access or authentication, secure access filtering ...).

4. Rules of use, security and proper use

Every user is responsible for the use of the computer resources and internet services that he/she has access.

He/she is also responsible, at his/her level, to contribute to the overall safety of the laboratory.

The use of these resources must be rational and compliant in order to avoid saturation or their misuse for personal gain.

In particular, the user:

 Must follow the safety recommendations of the laboratory to which he/she belongs,

 Must protect his/her personnal information and he/she is responsible for the rights he/she gives to other users, he/she must protect his/her data using his/her own personal means of backupor the different means that are made available this purpose,

 Must report any attempted of hacking of their account and, generally, any anomaly that can be seen,

 Must follow the software installation rules imposed by the GATE Lyon St-Etienne,

 Must chose secure passwords, keep them secret and under any circumstances do not disclose it to third parties

 Must not unauthorized people to access the system or network, through the devices that are under his/her responsability,

 Must not use or attempt to access the accounts of other user or hide his/her true identity,

 Should not try to read, edit, copy, or destroy data other than those that belong to him, directly or indirectly. In particular, he/she should not modify the file or files containing accounting information or identification,

 Must not leave his/her computer session or self-service open without logging out from the resources or services available.

Each user is responsible for the use of computer resources (local or remote) connected from his account. This includes taking a few precautions, simple but effective:

 Respect the security of passwords.

 Keep your password secret (do not give it to someone else, not even members of the department).

 Terminate properly the sessions and not to leave the terminal with an open session.

 Inform the department from any attempted violation of your account.

 Protect your files (remove unnecessary access)

 The possibility of editing a file does not imply the permission to edit it.

 The attempt to violate any identity is a crime.

Use of personal laptop is tolerated in the laboratory. Such use is only for business purposes. The department is not responsible in any circumstance of any problem that may occur to the personal material (viruses, hacking, damage or virtual hardware). The computer can be connected to the laboratory network, in which case the computer will be subject to the same rules as the machines of GATE Lyon St-Etienne. The owner must allow to the department unrestricted access to his/her machine. The department reserves the right at any time to suspend the authorization of personal computer usage without cause or notice. The department of GATE Lyon St-Etienne has no obligation to maintain or repair of personal computers. GATE Lyon St-Etienne's software can never be installed on these computers.

GATE Lyon St-Etienne, represented by its Director reserves the right to verify, by all means available, the proper use of its computer network in reference to the recommendations made by RENATER (National Network of Teaching and Research), the departmental authorities and the Commission Nationale Informatique et Liberté (CNIL). Any user who infringes the rules defined by this Charter, as well as those relating to Intellectual Property Code or recommendations issued by the CNIL and RENATER, is liable to disciplinary or legal proceedings in cases of criminal offenses.

5. Compliance with legislation concerning software

It is strictly forbidden to make copies of commercial software for any purpose whatsoever, except for one backup copy as predicted in the Code of intellectual property. These can only be performed by the person authorized for that purpose by the Director of GATE Lyon St-Etienne. Furthermore, the user should not install software for entertainment, or violate the restrictions of any software usage.

The availability of software and its installation is provided by the IT department of GATE Lyon St-Etienne based on specific agreements with distributors or by reference to the agreements authorized by ministerial whatever type of software license.

The computer configuration and the installation of new software are made exclusively by the IT department's laboratory.

6. Preserving the integrity of computer systems

User agrees not to voluntarily cause disruption to the smooth operation of computer systems and networks, either by abnormal manipulation of the material, or the introduction of software known under the generic name of viruses, Trojans Troy, logic bombs .... Any research or other, might lead to the violation of the rule defined in the preceding paragraph, can be accomplished only with the permission of the head of the GATE Lyon St-Etienne and in strict compliance rules that may be defined.

7. Use of Internet services (web, mail, forum ...)

Users must use Internet services as part of his/her exclusive and professional activities in accordance with general principles and rules specific to the various sites offering them and in compliance with the legislation.

In particular, the user:

 Must not connect or try to connect to a server other than the provisions of this server or unless authorized by the authorized managers,

 Should not engage in acts that might intentionally compromise the security or proper operation of the servers that are accessed,

 Must not steal the identity of another person and not intercept communications between third parties,

 Should not use these services to provide or make available to third parties of confidential data and information or contrary to law,

 Should not file documents on a server unless it permits or unless authorized by the authorized managers,

 He/She must exercise the utmost correction against its counterparts in electronic exchanges by mail, discussion forums ...

 He/She will not disclose personal views outside his professional activity likely to harm the GATE, CNRS, Université Lumière Lyon 2 or ENS Lyon.

 He/She must respect the laws, including those relating to publications abusive, racist, pornographic, libelous.

The GATE Lyon St-Etienne and its representatives will not be held responsible for the deterioration of information or offenses committed by a user who does not conform to these rules.

8. Reminder of the main legal provisions

The legislation, regulations, and this charter define the rights and obligations of people using computer

resources. Any user who has not respected the law may be prosecuted. In addition, users who do not respect the rules and obligations set forth in the charter are subject to disciplinary sanctions. The network administrator reserves the right to take all precautionary measures in case of emergencies or serious or repeated safety rules violations to safeguard the integrity of the network and desktops of its users.

It is recalled that any person on French soil must respect French law in particular in the field of computer security:

 Law of 6/1/78 called "Computing and Freedom" (cf. http://www.cnil.fr/)

 Law on computer fraud (Article 323-1 to 323-7 of the Penal Code) (see http://www.legifrance.gouv.fr/citoyen/code.cgi)

 The legislation on intellectual property (cf. http://www.legifrance.gouv.fr/citoyen/code.cgi)

 The law of 08.04.1994 on the use of French language (cf. http://www.culture.fr/culture/dglf/)

10. Privacy Terms

The user access to information and documents stored on computer systems must be limited to those that belong to them and those that are public or shared. In particular, it is forbidden to take in information held by others, even if they are not explicitly protected.

This rule also applies to private conversations like e-mail in which the user is neither the main recipient nor in copy. If, in carrying out his/her work, the user is prompted to create files that fall under the Data Protection Act, he/she must previously request an authorization to the CNIL in consultation with the Director of GATE Lyon St-Etienne and have given a permission. It is recalled that this authorization is valid only for the treatment described in the application and not the file itself.

The GATE Lyon St-Etienne department must respect the confidentiality of user files, mail, printings and outputs to which they may need to access. This privacy statement applies particularly during the access to files or emails of the users for security reasons, by the administrator or authorized members of the department.

11. Tracking

Requirements for maintenance and technical management, use of hardware or software resources and exchanges via the network can be analyzed and tested for compliance with applicable laws including the Law

“Informatique et Liberté”.

The network administrator can monitor the GATE Lyon St-Etienne in detail the working sessions of a user if there is a suspicion of non-compliance with the Charter. They can change the priority or stop a user's job if excessive use of resources to disturbs the other users (with or without notice, depending on the severity of the problem).

This charter must be obligatory signed.
