Overwegende hetgeen volgt:

(1) Artikel 228 §3 1° van het Federaal Technisch Reglement (hierna 'FTR') stelt dat:

a. de transmissiesysteembeheerder na openbare raadpleging een voorstel (hierna 'LFC Means') ter goedkeuring indient, met de methode om voor elk van de balanceringsdiensten de balanceringscapaciteit te bepalen die binnen het LFC-blok van Elia moet worden gereserveerd;

b. dit voorstel ter goedkeuring wordt voorgelegd tegelijk met de operationele overeenkomst voor het LFC-blok (hierna 'LFCBOA'), zijnde het voorstel vermeld in artikel 6(3)e van Verordening (EU) 2017/1485 van de Commissie van 2 augustus 2017 tot vaststelling van richtsnoeren betreffende het beheer van het elektriciteitstransmissiesysteem (hierna 'SOGL');

c. de methodologie in het voorstel gebaseerd zal zijn op een analyse van de optimale terbeschikkingstelling van reservecapaciteit zoals vermeld in artikel 32(1) van Verordening (EU) 2017/2195 van de Commissie van 23 november 2017 tot vaststelling van richtsnoeren voor elektriciteitsbalancering (hierna 'EBGL').

(2) De door Elia System Operator (hierna 'Elia') te reserveren balanceringscapaciteit voor FCR wordt bepaald door alle TSB's van de synchrone zone, in toepassing van de bepalingen van artikel 153 van de Europese SOGL-richtsnoeren, en wordt vermeld in de operationele overeenkomst voor de synchrone zone (hierna 'SAOA').

(3) De in artikel 6(3)e vermelde LFCBOA definieert de methodologie om de noden te bepalen aan reservecapaciteit die geen FCR is. Deze wordt ontwikkeld door de transmissiesysteembeheerder van het LFC-blok in overeenstemming met artikel 119 van de SOGL. De LFCBOA wordt door Elia ter goedkeuring voorgelegd in overeenstemming met artikel 6(3)e en 119(2) van de SOGL.

(4) Krachtens artikel 32(1) van de EBGL maakt elke TSB een analyse van de optimale terbeschikkingstelling van reservecapaciteit, die erop gericht is de kosten die verband houden met de terbeschikkingstelling van reservecapaciteit tot een minimum te beperken. Deze analyse houdt rekening met de volgende opties voor de terbeschikkingstelling van reservecapaciteit:

a. de inkoop van balanceringscapaciteit in de regelzone en de uitwisseling van balanceringscapaciteit met naburige TSB's, voor zover van toepassing;

b. het delen van reserves, voor zover van toepassing;

c. het volume van niet-gecontracteerde balanceringsenergiebiedingen die naar verwachting beschikbaar zullen zijn, zowel in hun regelzone als op de Europese platforms, rekening houdende met de beschikbare zoneoverschrijdende capaciteit.

(5) Krachtens artikel 228 §3 2° van het FTR geldt het volgende:

a. indien de periode van aankoop van balanceringscapaciteit gelijk is aan of langer is dan één jaar, legt de TSB het resultaat van de praktische toepassing van de dimensioneringsregels ter goedkeuring voor aan de regulerende instantie;

b. voor alle andere periodes van aankoop van balanceringscapaciteit worden de volumes aan balanceringscapaciteit na de toepassing van de dimensioneringsregels door de TSB onmiddellijk door deze laatste gemeld bij de nationale reguleringsinstantie.

(6) Elia heeft de belanghebbenden geraadpleegd over het ontwerpvoorstel overeenkomstig artikel 10 van de EBGL. Deze raadpleging heeft plaatsgevonden van 4 oktober 2019 tot 4 november 2019.

LEGT HET VOLGENDE VOORSTEL TER GOEDKEURING VOOR AAN DE CREG:

TITEL 1 Inleiding

1. Conform artikel 228 §3 van het FTR is dit document (hierna 'LFC Means') een voorstel dat Elia heeft ontwikkeld met betrekking tot de methodologie voor het bepalen van de volumes aan balanceringscapaciteit voor aFRR en mFRR binnen het LFC-blok van Elia. De bepaling van de volumes aan balanceringscapaciteit houdt rekening met het volume aan gedeelde reserve en niet-gecontracteerde balanceringsenergiebiedingen.

2. Voor zover mogelijk worden de volumes van de verschillende types balanceringsdiensten berekend en voorgesteld op basis van de bovenvermelde methodologie.

TITEL 2 Algemene bepalingen Doelstelling

1. Door de te reserveren balanceringscapaciteit te bepalen, draagt de LFC Means bij tot de algemene doelstellingen die in artikel 3 van de EBGL worden bepaald:

a. effectieve mededinging, non-discriminatie en transparantie op de balanceringsmarkten bevorderen;

b. de efficiëntie van balancering en van de Europese en nationale balanceringsmarkten verbeteren;

c. de balanceringsmarkten integreren en de mogelijkheden voor de uitwisseling van balanceringsdiensten bevorderen, en tegelijk bijdragen tot de operationele veiligheid;

d. bijdragen tot de efficiënte langetermijnexploitatie en -ontwikkeling van het elektriciteitstransmissiesysteem en de elektriciteitssector in de Unie, en tegelijk de efficiënte en consistente werking van day-aheadmarkten, intradaymarkten en balanceringsmarkten vergemakkelijken;

e. garanderen dat de inkoop van balanceringsdiensten eerlijk, objectief, transparant en marktgebaseerd is, dat er geen ongeoorloofde belemmeringen voor nieuwe marktdeelnemers worden gecreëerd, dat de liquiditeit van balanceringsmarkten wordt bevorderd en dat ongeoorloofde verstoringen op de interne markt voor elektriciteit worden voorkomen;

f. de deelname van vraagrespons vergemakkelijken, met inbegrip van aggregatiefaciliteiten en energieopslag, en er tegelijkertijd voor zorgen dat zij concurreren met andere balanceringsdiensten op een gelijk speelveld en, voor zover nodig, onafhankelijk optreden als ze één verbruikersinstallatie bedienen;

g. de deelname van hernieuwbare energiebronnen vergemakkelijken en bijdragen tot de verwezenlijking van de doelstelling van de Europese Unie betreffende de doorbraak van hernieuwbare energiebronnen.

Definities en interpretaties

1. De in deze LFC Means gebruikte termen hebben de betekenis van de definities in artikel 3 van de SOGL en artikel 2 van de EBGL.

2. Alle verwijzingen naar andere wetten worden expliciet vermeld. Alle artikelen zonder expliciete verwijzing naar andere wetten zijn artikelen van deze LFC Means.

3. 'mFRR Standard' wordt gedefinieerd als het mFRR-capaciteitsproduct dat wordt gekenmerkt door een onbeperkte activeringstijd en geen neutralisatietijd, zoals bepaald in de Voorwaarden voor de aanbieders van balanceringsdiensten voor Frequentieherstelreserves met manuele activering (mFRR), hierna ‘T&C BSP mFRR’.

4. 'mFRR Flex' wordt gedefinieerd als het mFRR-capaciteitsproduct dat wordt gekenmerkt door een beperkte activeringstijd en een neutralisatietijd tussen twee opeenvolgende activeringen, zoals bepaald in de T&C BSP mFRR.

TITEL 3 Methodologie

Dimensionering van de reservecapaciteit voor aFRR en mFRR

1. Elia bepaalt de waarde voor de noden aan positieve en negatieve reservecapaciteit voor aFRR en mFRR aan de hand van de methodologieën die in artikel 8 en 9 van de LFCBOA worden uiteengezet:

a. Elia bepaalt een vaste waarde voor de positieve en negatieve aFRR noden op basis van de statische dimensioneringsmethodologie die in de recentste goedgekeurde versie van de LFCBOA wordt vermeld.

b. Elia bepaalt voor elk van de zes periodes van vier uur een waarde voor de positieve en een waarde voor negatieve mFRR noden op basis van de dynamische dimensioneringsmethodologie die in de recentste goedgekeurde versie van de LFCBOA wordt vermeld.

Delen van reserves

1. Conform artikel 32(1) van de EBGL en artikel 10 van de LFCBOA houdt Elia in de dimensionering van haar balanceringscapaciteit rekening met het delen van reservecapaciteit met naburige TSB's. Dit heeft uitsluitend betrekking op overeenkomsten voor het delen van mFRR met andere TSB's, aangezien Elia geen overeenkomsten voor het delen van aFRR met andere TSB's heeft.

2. Elia beschikt over overeenkomsten voor het delen van mFRR met RTE, TENNET en NGET, die het delen van mFRR met naburige TSB's faciliteren. Elk van deze overeenkomsten wordt verwacht in 2020 operationeel te zijn en zal een positieve en negatieve gedeelde capaciteit van 350 MW faciliteren.

3. Het maximale gedeelde volume voor positieve reserve op mFRR dat in aanmerking kan worden genomen wordt berekend volgens artikel 10(1) van de LFCBOA.

4. Het maximale gedeelde volume voor negatieve reserve op mFRR dat in de dimensionering in aanmerking kan worden genomen wordt berekend volgens artikel 10(2) van de LFCBOA.

5. Conform artikel 10(3) van de LFCBOA houdt Elia rekening met restricties op de operationele veiligheidslimieten en de vereisten voor de beschikbaarheid van de dienst voor het delen van mFRR:

a. deze reserves kunnen slechts worden geactiveerd in uitzonderlijke omstandigheden, zoals beschreven in de operationele overeenkomsten voor het delen van de mFRR-reserve om het evenwicht in het LFC-blok in stand te houden gedurende een beperkt aantal uren en op die manier een gedeelte van de mFRR- noden te dekken. Ze worden meestal geactiveerd nadat alle andere beschikbare balanceringsmiddelen (de niet-gecontracteerde balanceringsenergiebiedingen en de balanceringscapaciteit) gebruikt zijn.

b. Deze reserves zijn nooit gegarandeerd, aangezien de beschikbaarheid van grensoverschrijdende capaciteit niet verzekerd is en afhangt van de operationele beschikbaarheid van interconnectiecapaciteit aan de grenzen, de operationele veiligheidslimieten van het net (interne congestie in het net) en de beschikbaarheid van diensten voor het delen van reserves, zoals vermeld in de overeenkomsten met andere TSB's voor het delen van mFRR.

6. De activering van gedeelde reserves moet een uitzonderlijke maatregel blijven. In overeenstemming met artikel 4(5) en na een daling van het betrouwbaarheidsniveau van 99.9% (in 2018) naar 99.0% (in 2019) zoals bepaald door het percentiel van de probabilistische distributie van de potentiële positieve en negatieve onbalansen van het LFC-blok volgens artikel 8(2) van de recentste goedgekeurde versie van de LFCBOA legt Elia, uit voorzichtigheid en om de geplande activeringen te beperken:

a. de in de dimensionering opgenomen positieve gedeelde capaciteit vast op 50 MW;

b. de in de dimensionering opgenomen negatieve gedeelde capaciteit vast op 350 MW.

Niet-gecontracteerde balanceringsenergiebiedingen

1. Elia bepaalt het volume van de niet-gecontracteerde balanceringsenergiebiedingen die in aanmerking kunnen worden genomen om de vereiste reservecapaciteit in FRR te dekken op basis van een analyse van de historische beschikbaarheid van deze niet- gecontracteerde balanceringsenergiebiedingen voor aFRR en mFRR voor een periode van twee jaar (van 1 juli 2017 tot 30 juni 2019).

2. Elia beschikt momenteel niet over mechanismen voor de uitwisseling van niet- gecontracteerde energiebiedingen voor aFRR of mFRR op de Europese platformen.

3. Elia bepaalt de beschikbaarheid van alle niet-gecontracteerde balanceringsenergiebiedingen voor aFRR. Deze beschikbaarheid blijkt niet hoger te zijn dan 75% (incrementele biedingen) of 43% (decrementele biedingen) van de waargenomen kwartieren.

4. Elia bepaalt de beschikbaarheid van alle niet-gecontracteerde balanceringsenergiebiedingen voor mFRR. Elia zal niet-gecontracteerde balanceringsenergiebiedingen voor mFRR slechts in de dimensionering in rekening nemen indien het volume aan niet-gecontracteerde balanceringsenergiebiedingen voor mFRR samen met het volume aan gedeelde reserves voor mFRR volstaat om alle mFRR-noden te dekken.

5. De berekening van het beschikbare volume aan niet-gecontracteerde balanceringsenergiebiedingen voor mFRR wordt gebaseerd op de som van de verschillende types positieve en negatieve niet-gecontracteerde balanceringsenergiebiedingen voor elk kwartier van de in artikel 5(1) beoogde gegevens.

Deze berekening:

a. omvat alle incrementele en decrementele biedingen van niet-gecontracteerde energiebiedingen op 'coördineerbare' thermische eenheden en 'bidladder':

i. 'coördineerbaar' verwijst naar een kenmerk van een Leveringspunt DPSU

dat technisch in staat is om op verzoek van Elia zijn vermogensinjectie op het Elia-net binnen de 15 minuten te wijzigen;

ii. 'bidladder' verwijst naar niet-gecontracteerde balanceringsenergiebiedingen op leveringspunten zonder biedverplichtingen zoals vermeld in artikel 226 van het FTR.

b. omvat alle biedingen van pompopslageenheden:

i. incrementele biedingen alleen tijdens de ochtend (04.00 – 08.00 uur) vanwege energiebeperkingen;

ii. decrementele biedingen behalve tijdens de ochtend (04.00 – 08.00 uur) vanwege energiebeperkingen.

c. omvat alle verwachte biedingen van windkracht in 2020, gebaseerd op de historische productienominaties en rekening houdend met de toenemende capaciteit tussen 2017-2019 en 2020.

6. De berekening van het beschikbare volume aan niet-gecontracteerde balanceringsenergiebiedingen wordt aangevuld met de beschikbare capaciteit voor het delen van FRR via de beschikbare interconnectiecapaciteit (ATC) na intraday voor dezelfde tijdspanne. Deze resterende interconnectiecapaciteit is beperkt tot:

a. de gedeelde capaciteit per grens zoals vermeld in artikel 4(2);

b. de positieve en negatieve gedeelde capaciteit zoals vermeld in artikel 4(6).

Uit de analyse van de beschikbaarheid van niet-gecontracteerde balanceringsenergie voor mFRR blijkt dat:

a. er geen significante positieve capaciteit beschikbaar is;

b. aanzienlijke decrementele volumes van 800 MW tot 900 MW naar verwachting gedurende 95% tot 94% van de tijd beschikbaar zullen zijn en dat dit beschikbaarheidsniveau naar verwachting verder zal stijgen.

Balanceringscapaciteit

1. Zoals vermeld in artikel 4(1) beschikt Elia niet over gedeelde reserves voor aFRR. Zoals vermeld in artikel 5(2) zijn niet-gecontracteerde balanceringsenergiebiedingen voor aFRR niet voldoende beschikbaar om een deel van de vereiste reservecapaciteit voor aFRR te dekken. Bijgevolg wordt het volume aan 'aFRR balanceringscapaciteit / secundaire reserve' bepaald als gelijk aan de waarde van de vereiste reservecapaciteit volgens artikel 3, namelijk 145 MW. Het aankoopproces en productievereisten worden gespecifieerd in de T&C BSP aFRR, en tot hun inwerkingtrede in de Marktwerkingsregels voor de compensatie van de kwartuuronevenwichten, ook gekend als de Balanceringsregels.

2. Elia zal de vereiste resterende positieve reservecapaciteit voor mFRR (rekening houdend met het delen van reserves en niet-gecontracteerde balanceringsenergiebiedingen zoals gespecificeerd in Artikel 4 en Artikel 5) dekken voor een volume aan 'mFRR balanceringscapaciteit / tertiaire reserve' gelijk aan de waarde van de vereiste resterende reservecapaciteit. Het aankoopproces en de productievereisten worden vermeld in de T&C BSP mFRR en tot hun inwerkingtrede in de Balanceringsregels.

3. Elia beschikt momenteel niet over mechanismen voor de uitwisseling van balanceringscapaciteit voor aFRR of mFRR met naburige TSB's.

4. Elia zal de vereiste positieve reservecapaciteit voor mFRR dekken met een capaciteit mFRR Standard die wordt bepaald door het minimum van een op 490 MW vastgelegde drempel en de vereiste mFRR-balanceringscapaciteit. Als de resterende vereiste positieve reservecapaciteit positief is, wordt ze aangekocht door middel van de producten mFRR Standard en mFRR Flex.

5. De aan te kopen positieve balanceringscapaciteit op mFRR wordt elke dag voor 07.00 uur voor elke periode van vier uur van de volgende dag gepubliceerd en in overeenstemming met artikel 228 §3 2° van het FTR gemeld bij de nationale reguleringsinstantie.

6. De in paragraaf 4 vermelde minimumcapaciteit zal vanaf 1 juli 2020 worden verhoogd tot 640 MW.

7. Elia zal geen negatieve mFRR-balanceringscapaciteit aankopen, aangezien de vereiste negatieve reservecapaciteit voor mFRR naar verwachting zal worden gedekt door de beschikbare reservedeling en de beschikbare niet-gecontracteerde balanceringsenergiebiedingen zoals vermeld in artikel 3, met een aanvaardbare waarschijnlijkheid.

8. Elia zal een jaarlijkse ex post analyse uitvoeren in het eerste kwartaal van elk jaar, op basis van historische gegevens van het vorige jaar, en zal nagaan of de positieve en negatieve FRR-noden voldoende door de beschikbare middelen worden gedekt. Met het oog op deze analyse zal Elia de resultaten van de positieve en negatieve FRR-noden op basis van de methodologie van de LFCBOA vergelijken met de beschikbare bronnen van aFRR (gecontracteerde aFRR-balanceringscapaciteit) en mFRR (niet-gecontracteerde balanceringsenergieaanbiedingen en delen van FRR-reserves).

TITEL 4 Volumes vanaf 1 januari 2020

Volumes aan balanceringscapaciteit voor de implementatie van de dagelijkse aankoop

1. Tot de inwerkingtreding, zoals vermeld in TITEL 5, van de in TITEL 3 uiteengezette methodologie, namelijk de dagelijkse aankoop van reservecapaciteit, zal Elia het voor 2019 goedgekeurde gebruik van volumes voor balanceringscapaciteit verlengen:

a. 145 MW aFRR

b. 844 MW mFRR met minstens 314 MW mFRR Standard

TITEL 5 Slotbepalingen

Tijdsplanning voor de implementatie

1. De LFC Means treedt onmiddellijk in werking na goedkeuring door de nationale regelgevende instantie, de CREG, met uitzondering van TITEL 3, dat in werking treedt op de dag van inwerkingtreding van de T&C BSP mFRR.

Taal

1. Dit document wordt in het Engels, het Nederlands en het Frans gepubliceerd. In geval van onenigheid over de interpretatie van de in de LFC MEANS voorgestelde methodologieën hebben de Franse en de Nederlandse versie voorrang op de Engelse versie.

Considérant ce qui suit

(1) L’article 228, paragraphe 3, 1° du Règlement Technique Fédéral (ci-après « RTF ») spécifie que :

a. le gestionnaire de réseau de transport, après consultation publique, soumet une proposition pour approbation (ci-après « LFC Means ») contenant la méthodologie pour déterminer, pour chacun des services d’équilibrage, la capacité d’équilibrage à réserver au sein du bloc RFP d’Elia;

b. cette proposition est soumise pour approbation en même temps que l’Accord d’Exploitation de bloc RFP (ci-après « LFCBOA »), soit la proposition spécifiée à l’article 6(3)e du Règlement (UE) 2017/1485 de la Commission du 2 août 2017 établissant une ligne directrice sur la gestion du réseau de transport de l’électricité (ci-après « SOGL ») ;

c. la méthodologie dans la proposition est basée sur une analyse de la fourniture optimale telle que spécifiée à l’article 32(1) du Règlement (UE) 2017/2195 de la Commission du 23 novembre 2017 concernant une ligne directrice sur l’équilibrage du système électrique (ci-après « EBGL »).

(2) La capacité d'équilibrage FCR à réserver par Elia System Operator (ci-après « Elia ») est déterminée par tous les GRT de la zone synchrone, en application de l’article 153 des lignes directrices européennes SOGL et de l’Accord d'Exploitation de Zone Synchrone (ci-après « SAOA »).

(3) Le LFCBOA visé à l’article 6(3)e fixe la méthodologie permettant de déterminer les besoins de capacité de réserve autres que FCR. Cette méthodologie est développée par le gestionnaire de réseau de transport du bloc RFP, conformément à l’article 119 de la SOGL. Le LFCBOA est soumis pour approbation par Elia, conformément aux articles 6(3)e et 119(2) de la SOGL.

(4) Conformément à l’article 32(1) de l’EBGL, chaque GRT effectue une analyse de la fourniture optimale de capacité de réserve, en vue de réduire au minimum les coûts associés à cette fourniture. Cette analyse tient compte des options suivantes pour la fourniture de capacité de réserve :

a. l'acquisition de capacité d'équilibrage au sein de la zone de contrôle et l’échange de capacité d'équilibrage avec les GRT voisins, le cas échéant ;

b. le partage des réserves, le cas échéant ;

c. le volume des offres d'énergie d'équilibre non contractualisées dont on prévoit la mise à disposition au sein de leur zone de contrôle et sur les plateformes européennes, compte tenu de la capacité disponible entre zones.

a. si la période d'achat de capacité d'équilibrage est égale ou supérieure à un an, le résultat de l'application pratique des règles de dimensionnement est soumis par le GRT à l’autorité nationale de régulation pour approbation ;

b. pour toutes les autres périodes d'achat de capacité d'équilibrage, le résultat de l'application pratique des règles de dimensionnement par le GRT est immédiatement notifié par ce dernier à l’autorité nationale de régulation.

(6) Elia a consulté les parties prenantes sur le projet de proposition conformément à l'article 10 de la EBGL. Cette consultation s'est déroulée du 4 octobre 2019 au 4 novembre 2019.

TITRE 1 Introduction

1. Conformément à l’article 228, paragraphe 3 du RTF, le présent document (ci-après « LFC Means ») est une proposition développée par Elia quant à la méthodologie pour déterminer les volumes de capacité d'équilibrage aFRR et mFRR pour le bloc RFP d’Elia. La détermination des volumes de capacité d'équilibrage tient compte du volume de partage de réserves et des offres d’énergie d'équilibre non contractualisées.

2. Quand c’est possible, les volumes de différents types de services d'équilibrage sont calculés et proposés sur la base de la méthodologie susmentionnée.

TITRE 2 Dispositions générales Objectif

1. En déterminant la capacité d'équilibrage à réserver, les LFC Means contribuent aux objectifs généraux définis à l’article 3 de l’EBGL :

a. promouvoir la concurrence, la non-discrimination et la transparence effectives sur les marchés de l'équilibrage ;

b. renforcer l'efficacité de l'équilibrage ainsi que l'efficacité des marchés européen et nationaux de l'équilibrage ;

c. intégrer les marchés de l'équilibrage et promouvoir les possibilités d'échanges de services d'équilibrage tout en contribuant à la sécurité d'exploitation ;

d. contribuer à l'exploitation et au développement efficaces à long terme du réseau de transport de l'électricité et du secteur de l'électricité dans l'Union tout en facilitant le fonctionnement efficient et cohérent des marchés journalier, infrajournalier et de l'équilibrage ;

e. assurer que l'acquisition de services d'équilibrage soit équitable, objective, transparente et fondée sur le marché, éviter de placer des obstacles indus à l'entrée de nouveaux acteurs, favoriser la liquidité des marchés de l'équilibrage tout en prévenant des distorsions indues au sein du marché intérieur de l'électricité ;

f. faciliter la participation active de la demande, notamment par des dispositifs d'agrégation et de stockage de l'énergie, tout en veillant à ce que la concurrence entre elles et les autres services d'équilibrage respecte des règles équitables et, le cas échéant, à ce qu'elles agissent de manière indépendante lorsqu'elles desservent une seule installation de consommation ;

g. faciliter la participation des sources d'énergie renouvelables et soutenir la réalisation de l'objectif de l'Union européenne concernant la pénétration de la production d'électricité à partir de sources renouvelables.

Définitions et interprétations

1. Aux fins des présentes LFC Means, les termes utilisés s’entendent dans le sens des définitions de l'article 3 de la SOGL et de l’article 2 de l’EBGL.

2. Toutes les références à d’autres actes législatifs sont explicitement définies. Tous les articles sans référence explicite à d'autres actes législatifs concernent des articles des présentes LFC Means.

3. « mFRR Standard » est défini comme le Produit de la Capacité mFRR caractérisé par un temps d’activation illimité et l’absence de temps de neutralisation, comme spécifié dans les Modalités et Conditions applicables aux fournisseurs de service d’équilibrage pour le service de Réserve de Restauration de la Fréquence avec activation manuelle (mFRR), (ci-après « T&C BSP mFRR »)

4. « mFRR Flex » est défini comme le Produit de la Capacité mFRR caractérisé par un temps d’activation limité et un temps de neutralisation entre deux activations successives, comme spécifié dans les T&C BSP mFRR.

TITRE 3 Méthodologie

Dimensionnement de la capacité de réserve aFRR et mFRR

1. Elia détermine la valeur des besoins en capacité de réserve aFRR et mFRR positifs et négatifs en suivant les méthodologies spécifiées aux articles 8 et 9 du LFCBOA :

a. Elia détermine une valeur fixe pour les besoins aFRR positifs et négatifs sur la base de la méthodologie de dimensionnement statique, comme spécifié dans la dernière version approuvée du LFCBOA.

b. Pour chacune des 6 périodes de 4 heures, Elia détermine une valeur pour les besoins mFRR positifs et une valeur pour les besoins négatifs pour le jour suivant, sur la base de la méthodologie de dimensionnement dynamique, comme spécifié dans la dernière version approuvée du LFCBOA.

Partage de réserves

1. Conformément à l’article 32(1) de l’EBGL et à l’article 10 du LFCBOA, Elia tient compte de du partage de capacité de réserve avec les GRT voisins lors du dimensionnement de sa capacité d'équilibrage. Cela concerne uniquement les accords en matière de partage de mFRR avec d’autres GRT étant donné qu’Elia n’a pas d’accords en matière de partage d’aFRR avec d’autres GRT.

2. Elia dispose d’accords de partage de réserves mFRR avec RTE, TENNET et NGET, qui facilitent le partage de mFRR avec les GRT voisins. Ces accords seront opérationnels en 2020 et faciliteront une capacité partagée positive et négative de 350 MW.

3. Le volume partagé maximal pour la réserve positive mFRR pouvant être pris en compte est calculé conformément à l’article 10(1) du LFCBOA.

4. Le volume partagé maximal pour la réserve négative mFRR pouvant être pris en compte pour le dimensionnement est calculé conformément à l’article 10(1) du LFCBOA.

5. Conformément à l’article 10(3) du LFCBOA, Elia tient compte des restrictions quant aux limites de la sécurité d’exploitation et quant aux exigences en matière de disponibilité du service de partage mFRR :

a. ces réserves peuvent uniquement être activées dans les conditions exceptionnelles décrites dans les accords d’exploitation régissant le partage de réserves mFRR en vue de maintenir l’équilibre du bloc RFP pour un nombre d’heures limité et ainsi couvrir une partie des besoins mFRR. Elles sont généralement activées après l’utilisation de tous les autres moyens disponibles de l'équilibrage (les offres d’énergie d’équilibre non contractualisées et la capacité d’équilibrage) ;

b. ces réserves ne sont jamais garanties étant donné que la disponibilité de la capacité transfrontalière n’est pas assurée. Elles sont dès lors sujettes à la disponibilité opérationnelle de la capacité d'interconnexion aux frontières, aux limites de la sécurité d’exploitation du réseau (congestions internes au réseau) et à la disponibilité du service de partage de réserves, tel que spécifié dans les accords avec d’autres GRT régissant le partage mFRR.

6. Conformément à l’article 4(5), ainsi qu’à une réduction du niveau de fiabilité déterminé par le percentile de la distribution de probabilité des potentiels déséquilibres positifs et négatifs du bloc RFP comme spécifié à l’article 8(2) de la dernière version approuvée du LFCBOA : de 99.9 % (en 2018) à 99.0 % (en 2019), Elia détermine par prudence, et en vue de limiter les activations planifiées (étant donné que l’activation du partage de réserves doit rester une mesure exceptionnelle) :

a. la capacité de partage positive inclue dans le dimensionnement à 50 MW ; b. la capacité de partage négative inclue dans le dimensionnement à 350 MW.

Offres d’énergie d’équilibrage non contractualisées

1. Elia détermine le volume d’offres d’énergie d’équilibrage non contractualisées pouvant être pris en compte pour couvrir la capacité de réserve FRR requise sur la base d’une analyse de la disponibilité historique de ces offres d’énergie d’équilibrage non contractualisées aFRR et mFRR sur une période de deux ans (du 1er juillet 2017 au 30 juin 2019).

2. Elia ne dispose actuellement d’aucun mécanisme pour l’échange d’offres d’énergie d’équilibrage non contractualisées aFRR ou mFRR sur les plateformes européennes.

3. Elia détermine la disponibilité de toutes les offres d’énergie d’équilibrage non contractualisées aFRR. On constate que cette disponibilité n’excède pas 75 % (offres incrémentielles) ou 43 % (offres décrémentielles) des quarts d’heure observés.

4. Elia détermine la disponibilité de toutes les offres d’énergie d’équilibrage non contractualisées mFRR. Elia ne tiendra compte que des offres d’énergie d’équilibrage non contractualisées mFRR dans le dimensionnement si le volume d’offres d’énergie d’équilibrage non contractualisées mFRR peut, avec le volume de partage de réserves mFRR, couvrir la totalité des besoins mFRR.

5. Le calcul du volume disponible d’offres d’énergie d’équilibrage non contractualisées mFRR se base sur la somme des différents types d’offres d’énergie d’équilibrage non contractualisées positives et négatives par catégorie pour chaque quart d’heure des données visées à l’article 5(1). Ce calcul :

a. inclut toutes les offres d’énergie d’équilibrage non contractualisées incrémentielles et décrémentielles sur les unités thermiques « coordonnables » et « BidLadder » : i. « Coordonnables » fait référence à la caractéristique d’un Point de Livraison DPSU techniquement capable de modifier son injection de puissance sur le Réseau Elia dans un délai de 15 minutes à la suite d’une demande émanant d’Elia ;

ii. « BidLadder » fait référence aux offres d’énergie d’équilibrage non contractualisées sur les points de livraison sans obligation de soumission comme spécifié à l’article 226 du RTF ;

b. inclut toutes les offres provenant des unités de pompage-turbinage :

i. offres incrémentielles uniquement le matin (04h00 – 08h00) en raison de contraintes énergétiques ;

ii. offres décrémentielles sauf le matin (04h00 – 08h00) en raison de contraintes énergétiques ;

c. inclut toutes les offres décrémentielles attendues de l’éolien en 2020, sur la base des nominations de production historiques, compte tenu de l’augmentation de capacité entre 2017-19 et 2020.

6. Le calcul du volume disponible d’offres d’énergie d’équilibrage non contractualisées est complété par la capacité de partage FRR disponible à travers la capacité d'interconnexion disponible (ATC) après l’infrajournalier pour la même période. Cette capacité d'interconnexion résiduelle se limite :

a. à la capacité partagée par frontière, comme spécifié à l’article 4(2) ; b. à la capacité positive et négative partagée, comme spécifié à l’article 4(6).

L’analyse de la disponibilité de l'énergie d’équilibrage non contractualisée mFRR montre : a. qu’aucune capacité positive significative n’est disponible ;

b. que des volumes décrémentiels substantiels de 800 à 900 MW devraient être disponibles entre 95 et 94 % du temps et que ce niveau de disponibilité devrait encore augmenter.

Capacité d'équilibrage

1. Comme spécifié à l’article 4(1), Elia ne dispose pas de partage de réserves pour aFRR.

Comme spécifié à l’article 5(2), les offres d’énergie d’équilibrage non contractualisées aFRR ne sont pas suffisamment disponibles pour couvrir une partie de la capacité de réserve aFRR requise. De ce fait, le volume de « capacité d'équilibrage aFRR/réserve secondaire » est équivalent à la valeur de la capacité de réserve requise selon l’article 3,

soit 145 MW. Le processus d’achat et les caractéristiques du produit sont spécifiés dans les T&C BSP aFRR, et jusqu'à leur entrée en vigueur, les règles de fonctionnement du marché relatif à la compensation des déséquilibres quart-horaires (également dénommées

« Règles d'équilibrage »).

2. Elia couvrira la capacité de réserve positive mFRR requise restante (après avoir tenu compte du partage de réserves et des offres d’énergie d’équilibrage non contractualisées comme spécifié aux articles 4 et 5) pour un volume de « capacité d'équilibrage mFRR/réserve tertiaire » égal à la valeur de la capacité de réserve requise restante. Le processus d’achat et les caractéristiques du produit sont spécifiés dans les T&C BSP mFRR, et jusqu'à leur entrée en vigueur, les Règles d’équilibrage.

3. Elia ne dispose actuellement d’aucun mécanisme pour l’échange de capacité d’équilibrage aFRR ou mFRR avec les GRT voisins.

4. Elia couvrira la capacité de réserve positive mFRR requise via une capacité de mFRR Standard déterminée par le minimum entre un seuil fixé à 490 MW et la capacité d'équilibrage mFRR requise. La capacité de réserve positive requise restante (si positive) est contractée via les produits mFRR Standard et mFRR Flex.

5. La capacité d’équilibrage mFRR positive à acquérir est publiée chaque jour avant 7h du matin pour chaque période de 4 heures du jour suivant et notifiée à l’autorité nationale de régulation conformément à l’article 228, paragraphe 3, 2° du RTF.

6. La capacité minimale spécifiée au paragraphe 4 passera à 640 MW au 1er juillet 2020.

7. Elia ne fera l’acquisition d’aucune capacité d'équilibrage mFRR négative étant donné que la capacité de réserve négative mFRR requise est prévue selon toute vraisemblance d’être couverte par le partage de réserves disponibles et les offres d’énergie d’équilibrage non contractualisées disponibles, comme spécifié à l’article 3.

8. Elia procèdera à une analyse ex post annuelle lors du premier trimestre de chaque année sur la base des données historiques de l’année précédente et déterminera si les besoins FRR positifs et négatifs ont été suffisamment couverts par les ressources disponibles. Aux fins de cette analyse, Elia comparera les résultats des besoins FRR positifs et négatifs sur la base de la méthodologie décrite dans le LFCBOA et les comparera aux ressources aFRR (capacité d'équilibrage aFRR contractualisée) et mFRR (offres d’énergie d'équilibrage non contractualisées et partage de réserves FRR) disponibles.

THE BELGIAN TRANSMISSION SYSTEM OPERATOR, TAKING INTO ACCOUNT THE FOLLOWING,

Whereas

(1) Article 228 §3 1° of the Federal Grid Code (hereafter referred to as FGC) specifies that:

a. the transmission system operator shall submit, after a public consultation, a proposal for approval (hereafter referred to as “LFC Means”) containing the methodology to determine for each of the balancing services, the balancing capacity that has to be reserved within the LFC block of Elia.

b. this proposal shall be submitted for approval at the same time as the LFC block Operational Agreement (hereafter referred to as “LFCBOA”), which is the proposal specified in Article 6(3)e of the Commission Regulation (EU) 2017/1485 of 2 August 2017 establishing a guideline on electricity transmission system operation (hereafter referred to as “SOGL”).

c. the methodology in the proposal shall be based on an analysis of the optimal provision as specified in Article 32(1) of Commission Regulation (EU)2017/2195 of 23 November 2017 establishing a guideline on electricity balancing (hereafter referred to as “EBGL”).

(2) The balancing capacity for FCR to be reserved by Elia System Operator (hereafter referred to as “Elia”) is determined by all TSOs of the synchronous zone in application of the provisions of Article 153 of the European guidelines SOGL and specified in the Synchronous Area Operational Agreement (hereafter referred to as SAOA).

(3) The LFCBOA referred to in Article 6(3)e determines the methodology to determine the needs for reserve capacity other than FCR. It is developed by the Transmission System Operator of the LFC block in accordance with Article 119 of the SOGL. The LFCBOA is submitted by Elia for approval in accordance with Articles 6(3)e and 119(2) of the SOGL.

(4) Pursuant Article 32(1) of the EBGL, each TSO shall perform an analysis on optimal provision of reserve capacity aiming at minimization of costs associated with the provision of reserve capacity. This analysis shall take into account the following options for the provisions of reserve capacity:

a. procurement of balancing capacity within control area and exchange of balancing capacity with neighboring TSOs, when applicable;

b. sharing of reserves, when applicable;

c. the volume of non-contracted balancing energy bids which are expected to be available both within their control area and within the European platforms taking into account the available cross-zonal capacity.

(5) Pursuant Article 228 §3 2° of the FGC:

a. if the period of purchase of balancing capacity is equal to or longer than one year, the result of the practical application of the dimensioning rules shall be submitted by the TSO to the NRA for approval;

b. for all other periods of purchase of balancing capacity, the volumes of balancing capacity following the application of the dimensioning rules by the TSO shall be notified immediately by the TSO to the NRA.

(6) Elia has consulted the stakeholders on the draft proposal in accordance with Article 10 of the EBGL. This consultation has taken place from October 4, 2019 until November 4, 2019.

TITLE 1 Introduction

1. Pursuant to Article 228 §3 of the FGC, this document (hereafter referred to as “LFC Means”) is a proposal developed by Elia regarding the methodology for determining the volumes of balancing capacity for aFRR and mFRR for the Elia LFC block. The determination of the volumes of balancing capacity takes into account the volume of reserve sharing and non-contracted balancing energy bids.

2. Where possible, the volumes of different types of balancing services are calculated and proposed based on the above-mentioned methodology.

TITLE 2 General Provisions Objective

1. By determining the balancing capacity to be reserved, the LFC Means contributes to the general objectives as defined in Article 3 of the EBGL:

a. fostering effective competition, non-discrimination and transparency in balancing markets;

b. enhancing efficiency of balancing as well as efficiency of European and national balancing markets;

c. integrating balancing markets and promoting the possibilities for exchanges of balancing services while contributing to operational security;

d. contributing to the efficient long-term operation and development of the electricity transmission system and electricity sector in the Union while facilitating the efficient and consistent functioning of day-ahead, intraday and balancing markets;

e. ensuring that the procurement of balancing services is fair, objective, transparent and market-based, avoids undue barriers to entry for new entrants, fosters the liquidity of balancing markets while preventing undue distortions within the internal market in electricity;

f. facilitating the participation of demand response including aggregation facilities and energy storage while ensuring they compete with other balancing services at a level playing field and, where necessary, act independently when serving a single demand facility;

g. facilitating the participation of renewable energy sources and support the achievement of the European Union target for the penetration of renewable generation.

Definitions and interpretations

1. For the purposes of this LFC Means, the terms used have the meaning of the definitions included in Article 3 of the SOGL and in Article 2 of the EBGL.

2. All references to other legislation is explicitly defined. All articles without explicit reference to other legislation concern articles in this LFC Means.

3. “mFRR Standard” is defined as the mFRR Capacity Product characterized by an unlimited activation time and no neutralization time, as specified in the Terms and Conditions for balancing service providers for manual Frequency Restoration Reserve (mFRR), hereafter referred to as “T&C BSP mFRR”.

4. “mFRR Flex” is defined as the mFRR Capacity Product characterized by a limited activation time and a neutralization time between two successive activations, as specified in the T&C BSP mFRR.

TITLE 3 Methodology

Dimensioning of the reserve capacity for aFRR and mFRR

1. Elia determines the value for positive and negative reserve capacity for aFRR and mFRR needs following the methodologies specified in Article 8 and Article 9 of the LFCBOA:

a. Elia determines one fixed value for the positive and negative aFRR needs based on the static dimensioning methodology as specified in the last approved version of the LFCBOA.

b. Elia determines for each of the 6 periods of 4 hours a value for positive and a value for negative mFRR needs for the next day based on the dynamic dimensioning methodology as specified in the last approved version of the LFCBOA.

Sharing of reserves

1. In line with Article 32(1) of the EBGL and Article 10 of the LFCBOA, Elia takes into account the sharing of reserve capacity with neighbouring TSOs in the dimensioning of its balancing capacity. This only concerns sharing agreements on mFRR with other TSOs as Elia does not have sharing agreements on aFRR with other TSOs.

2. Elia disposes of reserve sharing agreements on mFRR with RTE, TENNET and NGET that facilitate the sharing of mFRR with neighbouring TSOs. Each of these agreements is foreseen to be operational in 2020 and will facilitate a positive and negative shared capacity of 350 MW.

3. The maximum shared volume for positive reserve on mFRR that can be taken into account is calculated pursuant Article 10(1) of the LFCBOA.

4. The maximum shared volume for negative reserve on mFRR that can be taken into account in the dimensioning is calculated pursuant Article 10(2) of the LFCBOA.

5. Pursuant to Article 10(3) of the LFCBOA, Elia takes into account restrictions on operational security limits and the availability requirements of the mFRR sharing service :

a. these reserves can only be activated under exceptional conditions described in the operational agreements governing the sharing of the mFRR reserve to maintain the balance in the LFC block for a limited number of hours and thus cover part of the mFRR needs. They are generally activated after using all the other available balancing means (the non-contracted balancing energy bids and the balancing capacity);

b. these reserves are never guaranteed as the availability of cross-border capacity is not ensured and are therefore subject to the operational availability of interconnection capacity at borders, network operating safety limits (internal network congestions) and reserve sharing service availability, as specified in the agreements with other TSOs governing mFRR sharing.

6. Following Article 4(5), and a reduction of the reliability level determined by the percentile of the probability distribution of the potential positive and negative LFC block imbalances as specified in Article 8(2) of the last approved version of the LFCBOA : from 99.9% (in 2018) to 99.0% (in 2019), Elia determines as an act of prudence and in order to limit the planned activations as the activation of the sharing reserves must remain an exceptional measure:

a. the positive sharing capacity included in the dimensioning to 50 MW;

b. the negative sharing capacity included in the dimensioning to 350 MW.

Non-contracted balancing energy bids

1. Elia determines the volume of non-contracted balancing energy bids that can be taken into account to cover the required reserve capacity for FRR based on an analysis of the historical availability of these non-contracted balancing energy bids for aFRR and mFRR for a period of two years (from July 1, 2017 to June 30, 2019).

2. Elia has currently no mechanisms for the exchange of non-contracted balancing energy bids for aFRR or mFRR within the European platforms.

3. Elia determines the availability of all non-contracted balancing energy bids for aFRR. It is found that this availability does not exceed 75% (incremental bids) or 43% (decremental bids) of the observed quarter-hours.

4. Elia determines the availability of all non-contracted balancing energy bids for mFRR. Elia will only take into account non-contracted balancing energy bids for mFRR in the dimensioning if the volume of non-contracted balancing energy bids for mFRR can, together with the volume of reserve sharing for mFRR, entirely cover the entire mFRR needs.

5. The calculation of the available volume of non-contracted balancing energy bids for mFRR is based on the sum of different types of positive and negative non-contracted balancing energy bids per category for each quarter-hour of the data referred to in Article 5(1). This calculation :

a. includes all incremental and decremental bids of non-contracted balancing energy bids on ‘coordinable’ thermal units and ‘bidladder’:

i. ‘coordinable’ refers to characteristic of a Delivery Point DPSU which is technically capable of modifying its power injection on the Elia Grid upon request by Elia, within 15 minutes;

ii. ‘bidladder’ refers to non-contracted balancing energy bids on delivery points without bidding obligation as specified in Article 226 of the FGC;

b. includes all bids from pump storage units :

i. incremental bids only during morning (04h00– 08h00) due to energy constraints;

ii. decremental bids except during morning (04h00– 08h00) due to energy constraints.

c. includes all expected decremental bids from wind power in 2020, based on historic production nominations, taking into account the increasing capacity between 2017- 19 and 2020.

6. The calculation of the available volume of non-contracted balancing energy bids is complemented with the available FRR sharing capacity through the available interconnection capacity (ATC) after intra-day for the same time period. This remaining interconnection capacity is limited to :

a. the shared capacity per border as specified in Article 4(2);

b. the positive and negative shared capacity as specified in Article 4(6).

The analysis of the availability of non-contracted balancing energy for mFRR shows that:

a. no significant positive capacity is available;

b. substantial decremental volumes of 800 MW - 900 MW are expected to be available for 95 % - 94% of the time and this level of availability is expected to further increase.

Balancing Capacity

1. As specified in Article 4(1), Elia does not dispose of reserve sharing for aFRR. As specified in Article 5(2), non-contracted balancing energy bids for aFRR do not have sufficient availability to cover part of the required reserve capacity for aFRR. Therefore, the volume of "aFRR balancing capacity / secondary reserve" is determined equal to the value of required reserve capacity following Article 3(2), being 145 MW. The procurement process and product requirements are specified in the T&C BSP aFRR, and until their entry into force, the market functioning rules for the compensation of quarter-hourly imbalances (also referred to as the ‘Balancing Rules’)

2. Elia will cover the required remaining positive reserve capacity for mFRR (after taking into account reserve sharing and non-contracted balancing energy bids as specified in Article 4 and Article 5) for a volume “mFRR balancing capacity / tertiary reserve” equal to the value

of required remaining reserve capacity. The procurement process and product requirements are specified in the T&C BSP mFRR, and until their entry into force, the market functioning rules for the compensation of quarter-hourly imbalances (also referred to as the ‘Balancing Rules’).

3. Elia has currently no mechanisms for the exchange of balancing capacity for aFRR or mFRR with neighboring TSOs.

4. Elia will cover the required positive reserve capacity for mFRR with a capacity of mFRR Standard determined by the minimum of a threshold determined at 490 MW and the required mFRR balancing capacity. The remaining required positive reserve capacity, if positive, is procured by means of the products mFRR Standard and mFRR Flex.

5. The positive balancing capacity on mFRR to be procured is published each day before 7 AM for every period of 4 hours of the next day, and notified according to the NRA following Article 228 §3 2° of the FGC.

6. The minimum capacity specified in paragraph 4 will be increased to 640 MW as from July 1, 2020.

7. Elia will not procure any negative mFRR balancing capacity since the required negative reserve capacity for mFRR is expected to be covered by available reserve sharing and available non-contracted balancing energy bids as specified in Article 3 with an acceptable probability.

8. Elia will carry out a yearly ex-post analysis in the first quarter of each year based on historical data from the precedent year on and assess whether the positive and negative FRR needs have been sufficiently covered by the resources available. For the purposes of this analysis, Elia will compare the results of the positive and negative FRR needs based on the methodology in the LFCBOA and compare this with the available resources of aFRR (contracted aFRR balancing capacity) and mFRR (non-contracted balancing energy offers and sharing of FRR reserves).

TITLE 4 Volumes as from January 1, 2020

Volumes of balancing capacity before implementing daily procurement

1. Until the entry into force as specified in TITLE 5 of the methodology specified in TITLE 3, being the daily procurement of reserve capacity, Elia will extend the use of the volumes for balancing capacity as approved for 2019.

Timing for implementation

1. The LFC Means enter into force immediately after being approved by the national regulatory authority, the CREG, with the exception of TITLE 3 which will enter into force on the day of entry into force of the T&C BSP mFRR.
