À partir des études recensées, est-il possible de conclure qu'un des deux milieux, les établissements carcéraux ou la communauté, est préférable afin de meilleurs résultats? est difficile de répondre à cette interrogation étant donné que les études recensées révèlent certaines différences quant à la clientèle même recevant les services. En effet, les personnes détenues semblent présenter des difficultés plus sévères que les personnes n'ayant pas été incarcérées. Ainsi, on rencontre davantage de récidivistes parmi la clientèle en détention. Il semble toutefois que les programmes en milieu fermé permettent d'exercer un meilleur contrôle sur les participants aux divers services de traitement On ne doit toutefois pas interpréter ces résultats comme signifiant des programmes de il faudrait élargir le filet pénal en incarcérant des personnes qui ne l'auraient pas été autrement Ceci est plus important si l'on considère les difficultés éthiques associées au traitement en contexte
On remarque que les programmes dispensés en communauté ne sont souvent pas adaptés à recevoir cette clientèle judiciansée. Ces programmes de traitement devraient considérer leurs services en fonction de personnes contrevenantes, entre en offrant un meilleur encadrement en début de traitement ainsi qu'une prise en charge plus intensive et rapide en cas de risque de récidive. Par exemple, même si les programmes offerts dans la communauté quant à la violence conjugale et la délinquance sexuelle tentent de protéger la société ou les partenaires
