Liberalization, prices and tariffs
Restoring a couple of true facts about the electricity market
In the context of the law proposal relative to energy presently debated at th e National Assembly (the French Parliament), the "return tariff" amendment ha s just been adopted . In other words, it may be some kind of a remorse clause t o the alleged benefit of the eligible professionals who have chosen to get out o f the regulated price system, and have been exposed, after an initial drop i n prices, to a substantial increase of their electricity bill since 2003 .
The logic lies in a tenacious illusion that the French consumer is, in the long term , safe from fossil energy price increases thanks to the greatly amortized nuclea r park, and that the basic principle of the free market does not apply to electricity which should fall under the responsibility of centralized planning an d administrative regulation, from new plant investments to final user services .
However, even nuclear energy does not have the answer to all questions . If it can satisfy the baseload demand, it lacks flexibility to adapt to the peakloa d needs which depend far more heavily on the actual weather conditions . Th e opening of the market, ultimately meant to lessen the actors' profit margin s following the example of other deregulated sectors, also aims at easing the dail y balancing of the network and reinforcing our security of supply at the Europea n level .
It is the partial aspect of the French market's opening which disrupts it s operation, not the opposite !
Let us stop pointing the finger at the market, and claiming everywhere that n o electricity market can operate efficiently! We would be rejecting the obviou s fact that very short term (spot) physical markets bring the TSO's relief in thei r quest to balance the network on a daily basis . As electricity cannot be store d and as its consumption can fluctuate greatly from one hour to the other, on e day to the other, these markets are even crucial in adjusting injection an d withdrawal in the best economical conditions for each of the 24 hours of the da y after, 365 days a year . Without their participation, the risk of unbalance, or eve n failure, would increase in greater proportion . It is a reality that cannot b e
overlooked for the majority of the member states, and we will witness, in the nea r future, a premiere event in Continental Europe with the coupling of the French , Belgian and Dutch day-ahead markets enabling the improvement o f
interconnection management between these countries and their security o f supply . It is the result of a close cooperation between the exchanges, the TSO' s and the regulators involved, and it should spread quickly to other countries .

The short and medium term markets answer to the need of many professiona l consumers to determine in advance the price of their power supply . Most o f these needs do not exceed a 3-year horizon as outside factors are too importan t beyond that limit . Futures markets answer primarily to these professionals an d their suppliers' needs . The heavy industry, a huge power consumer, might wish t o secure its long and very long term commitments (10/15 or 20 years) . Off marke t answers, such as a dedicated consortium, may be provided to a small numbe r of multinational companies . It does not diminish in any way the legitimat e character of a futures market at the service of the greater number, enabling th e dynamic management of the energy risk .
Can a futures power market operate efficiently? The answer is provided by th e development of the German futures market which should clear 1000 TWh in 2006 , or twice its national consumption, and which progressively stands out as th e price reference for the European medium term electricity, a dominant positio n we can and need to dispute legitimately . If we don't, by default, th e unregulated price in Europe which we will sooner or later have to subscribe, wil l be deprived of its cheaper nuclear component, and, consequently, will b e largely dominated by the private giants of power production on the other side o f the Rhine .
The adequate questions to ask are the following : why the French forward marke t does not experience the same volume development and why the French powe r doesn't enjoy significantly cheaper unregulated prices, while its nuclea r production cost is far lower than the heavy polluting coal German generation ? The difference comes from the fact that the German market has been entirel y open to competition since 1999, and that power production is divided amon g several major actors . A wholesale market ten times bigger than ours allows th e German market to benefit from a liquidity premium . On the other hand, th e current French prices are based on a modest third of the total consumption . Th e other two thirds have not exercised their eligibility right since they benefit from a very favourable regulated tariff . Thus, in a competitive European market wher e the investment needs are huge, the incumbent utility is mechanically brought t o generate its profit margin on the one-third forming the free market, at th e marginal cost of the most expensive production unit . Moreover, it also needs t o import more and more often in order to satisfy the peakload demand .
The same operator if he had the freedom to act over a more important marke t (complete liberalization) would be able to lead a policy compatible with it s European development, including the capability to make necessary investment s to its production capacities (security of energy) . Increasing the number o f eligible customers and the competition with energy producers would allow a price drop, with all things being equal, and the development of the Frenc h wholesale market .

The return to a completely regulated market threatens the balance of th e French electric system and the construction of the Europe of energy mor e and more necessary to our nation .
The level of the regulated tariff is improperly low (green tariff at 28 € versu s a price of 53 € on the free market) because it reflects a historical excess o f nuclear supply, and has not integrated the increase of the peakloa d demand . Moreover, it has only been partially indexed on inflation . A n excessively low tariff sends a double negative signal :
- a signal of underinvestment in production capacities, especially durin g peak hours, since the MWh tariff does not make these investment s profitable .
- a signal of non-moderation of the demand, since cheap power does no t encourage a reduction of consumption, nor investments in techniques tha t are less demanding in energy, but still create value .
Despite its supporters' good intentions, and contrarily to common thinking , without the backup strength of an organised and auditable free market , the simple administrative regulation can potentially be a source of majo r strains on the network and have negative consequences on the price a t medium term .
We need to fill this unbearable gap between an excessively low tariff an d an excessively high market price by working on both ends, by progressivel y raising the tariff, and by giving more consistency to the market in order t o achieve a convergence between tariff and price .
Eliminating the market and maintaining the sole tariff represent a doubl e threat for the balance of the French market in pressuring both the suppl y and the demand, but completely opposite to the desirable way! I t promotes its isolation even though its active contribution to th e development of a unique energy market in Europe is needed more tha n ever.

Pour rétablir quelques vérités sur le marché de l'électricit é
Dans le cadre de la proposition de loi relative à l'Energie actuellement débattue à l'Assemblée nationale, l'amendement concernant la mise en place d'un « tarif d e retour » vient d'être adopté . Il s'agit en quelque sorte d'une clause de remord s dont pourraient bénéficier les clients professionnels éligibles qui avaient choisi d e sortir du tarif réglementé et qui, après une forte chute des prix, sont exposé s depuis 2003 à une hausse substantielle de leur facture d'électricité .
Le raisonnement repose sur une illusion tenace qui voudrait que le parc nucléaire , largement amorti, mette le consommateur français durablement à l'abri de l a hausse du prix des énergies fossiles, voire que le principe même du marché n e soit pas applicable à l'électricité, qui devrait, des investissements dans d e nouvelles centrales jusqu'aux services aux utilisateurs finals, relever de l a planification centralisée et de la régulation administrative .
Mais le nucléaire n'a pas réponse à tout. S'il peut satisfaire une demande régulièr e et prévisible (le ruban), il manque de flexibilité pour s'adapter à la demande au x heures de pointe (la dentelle), qui dépend bien davantage des variation s climatiques du moment . L'ouverture du marché, si elle a pour vocation ultime d e faire baisser les marges que s'attribuent les acteurs à l'instar des autres secteur s libéralisés, vise aussi à faciliter l'équilibrage quotidien du réseau et à renforce r notre sécurité d'approvisionnement au niveau européen .
C'est le caractère incomplet de l'ouverture du marché français qui perturb e son fonctionnement, pas l'inverse !
Arrêtons de fustiger le marché et de proclamer urbi et orbi qu'aucun marché d e l'électricité ne fonctionne de façon satisfaisante! C'est nier l'évidence s'agissan t des marchés physiques de très court terme (spot) qui, un peu partout en Europe , facilitent grandement le rôle des gestionnaires de réseau dans leur missio n d'équilibrage quotidien . L'électricité ne se stockant pas et sa consommatio n pouvant varier fortement d'une heure sur l'autre, d'un jour à l'autre, ils sont mêm e indispensables pour ajuster injection et soutirage dans les meilleures condition s économiques pour chacune des 24 heures de la journée du lendemain, 365 jour s par an . risque de déséquilibre, voire de délestage . C'est une réalité incontournable dans l a plupart des Etats membres et nous assisterons d'ici peu à une première e n Europe continentale avec le couplage des trois marchés spot français, belge e t hollandais afin d'améliorer la gestion des interconnexions entre ces pays, et don c la sécurité d'approvisionnement de l'ensemble . C'est le fruit d'une coopératio n étroite entre les bourses, les gestionnaires de réseau et les régulateur s
concernés, qui doit rapidement s'étendre à d'autres pays .
Quant aux marchés de court et moyen terme, ils répondent à un autre besoin : celui de nombreux consommateurs professionnels de fixer à l'avance le prix d e leur fourniture d'électricité . La plupart de leurs besoins n'excèdent pas trois an s car au-delà, les variables exogènes sont trop élevées . C'est à eux et à leurs fournisseurs que s'adressent en priorité les marchés à terme . L'industrie lourde , grosse consommatrice d'électricité, peut quant à elle choisir de sécuriser se s engagements à un horizon de long ou très long terme, à 10/15 ou 20 ans . De s réponses hors marché, du type consortium, peuvent alors être circonscrites à u n petit nombre de grandes entreprises multinationales . Cela ne diminue en rien l a légitimité d'un marché à moyen terme au service du plus grand nombre , permettant de gérer de façon dynamique le risque énergétique .
Un marché à terme de l'électricité peut-il fonctionner de façon satisfaisante? L a réponse est apportée par le développement du marché à terme allemand qu i traitera cette année près de 1000 TWh, soit deux fois sa consommation nationale , et donc s'impose peu à peu comme la référence du prix de l'électricité à moye n terme en Europe, une suprématie que nous devrions et pourrions légitimement lu i contester . A défaut, le prix libre de l'électricité en Europe, auquel nous devron s forcément tôt ou tard nous rallier, sera privé de sa composante la moins chère, l e nucléaire, et largement dominé par les géants privés d'Outre-Rhin .
Les questions à se poser sont donc plutôt les suivantes : pourquoi le marché à terme français ne connaît-il pas le même développement et pourquoi l'électricit é française, à laquelle le nucléaire assure pourtant un coût de production trè s inférieur, n'est-elle pas significativement moins chère que l'électricité allemande, à dominante charbon et fortement émettrice de CO2 ?
La différence tient au fait que le marché allemand est intégralement ouvert à l a concurrence depuis 1999, et la production partagée entre plusieurs acteur s significatifs . Un marché de gros dix fois supérieur au nôtre lui permet en outre d e bénéficier d'une prime de liquidité . En revanche, les prix français actuels son t établis au maximum sur le tiers de la consommation totale, puisque les deu x autres tiers n'ont pas exercé leur éligibilité et bénéficient d'un tarif réglementé trè s favorable . Ainsi, dans un marché européen concurrentiel, et où les besoin s d'investissement sont très importants, l'opérateur historique est mécaniquemen t amené à générer sa marge sur ce tiers qui constitue le marché libre, au coû t marginal de l'unité de production la plus chère . Il est par ailleurs de plus en plu s souvent contraint d'importer pour satisfaire la demande aux heures de pointe . Le même opérateur, agissant sur un marché domestique plus vaste (libéralisatio n complète), pourrait mener une politique de marge compatible avec so n développement européen et avec l'amélioration indispensable des capacités d e production (sécurité énergétique) . Augmenter le parc de clients éligibles tout e n favorisant l'émergence de la concurrence entre producteurs permettrait de fair e baisser les prix, toutes choses égales par ailleurs, et de développer le marché d e gros français .

Le retour à la réglementation complète du marché fragilise l'équilibre d u système électrique français et la construction de l'Europe de l'énergie d e plus en plus nécessaire à notre pays .
Le niveau du tarif réglementé est excessivement bas (tarif vert à 28 € contre u n prix de 53 € sur le marché libre) car il traduit un excédent historique d'offr e nucléaire et n'a pas pris en compte la croissance de la demande aux heures d e pointe . Il n'a de plus été que partiellement indexé à l'inflation . Un tarif trop ba s envoie un double signal négatif :
- un signal de sous investissement dans les capacités de production, notammen t de pointe, puisque le tarif du MWh ne rend pas rentables ces investissements . - un signal de non modération de la demande, puisque l'électricité peu chèr e
n'incite ni à la réduction de la consommation, ni à l'investissement dans de s techniques moins « gourmandes » en énergie, elles-mêmes créatrices de valeur . En dépit des bonnes intentions qui animent ses défenseurs, et contrairemen t aux idées reçues, la simple régulation administrative, sans la force de rappe l d'un marché organisé et auditable, est potentiellement porteuse de tension s graves sur le réseau et de conséquences négatives à moyen terme sur les prix . Il faut s'employer à réduire cet écart intenable entre tarif trop bas et prix d e marché trop haut en agissant aux deux extrêmes, en relevant progressivemen t le tarif et en donnant plus de consistance au marché pour que tarif et pri x finissent par converger .
Supprimer le marché et maintenir le tarif seul constituent donc un péril « au carr é
» pour l'équilibre du marché français, en pesant à la fois sur l'offre et sur l a demande, mais à l'inverse de ce qui serait souhaitable ! Il favorise son isolemen t alors que sa contribution active à la formation du grand marché unique d e l'énergie européen est plus que jamais requise .
