Le thème de ce mémoire intitulé – Le rôle de la bonne gouvernance dans la promotion des droits de l’homme – aborde un aspect de ces nouvelles dimensions des droits de l’homme dans le cadre de la mondialisation et la diligence de la communauté internationale et nationale à promouvoir et protéger les droits de l’homme par la mise à disposition de moyens et instruments susceptibles d’aider à faire face à la problématique se rapportant à l’humanisation de la mondialisation .
En dépit de l’immense l’importance acquise par les droits de l’homme dans la communauté contemporaine, mais cette grande préoccupation a été plus centrée sur la mise en place de normes internationale, et la reconnaissance sans pouvoir profiter à haut niveau de ces droits, et la réalisation de la jouissance effective de ces même droits, en ce qui concerne les individués, les collectivités et les différentes communautés de la société faibles et marginalisées, ainsi que dans les régions reculées dans les divers pays du monde.
La réalité des droits de l’homme reflète et est confrontée à des défis importants en raison des répercussions de la mondialisation, l’énorme inégalité économique et la terrible augmentation de la population, qui mettaient en cause l’utilisation d’un nouveau concept(de la bonne gouvernance) qui suit le rythme de l’évolution, et peut fournir de nouveaux moyens et instruments, digne de la protéger et promouvoir des droits de l’homme et de rendre les normes internationales relatives aux droits de l’homme, objet de l’exécution nationale .
La bonne gouvernance joue un rôle dans la promotion des droits de l’homme dans les quatre domaines qui pourraient être la clé lui permettant de traiter des questions d’instruments relatifs aux droits de l’homme, et une variété de moyens, ces domaines consistent en la participation et l’approfondissement la pratique de la démocratie, la lutte contre la corruption, la primauté du droit et l’amélioration de la prestation de service.
Ces moyens et instrument ont été soulignés en se basant sur deux approches principales liées entre elles, à savoir : l’approche globale des valeurs, qui se réfère à un système de valeurs et de principe, qui encadrent le comportement des individus, groupe et en conséquence les institutions, ainsi cette approche évoque les principes de la bonne gouvernance, consistant dans le cadre de ce rôle, les garanties de la promotion des droits de l’homme, à savoir, la participation, la transparence et la responsabilisation , et la primauté du droit, et exige l’activation de ces garanties, la réconciliation de l’Etat avec la communauté, sont activation exige également un système d’évaluation qui donne à l’argent public le respect requis et préserve les ressources de l’état de la déperdition et l’oriente vers la mise en œuvre des droits de l’homme. Et la seconde approche est l’approche institutionnelle, qui donne la priorité aux institutions efficaces et de bonnes performances dans la pratique, ainsi cette approche évoque les acteurs de la bonne gouvernance consistant, dans le cadre de ce rôle, en les mécanismes de la promotion des droits de l’homme, à savoir, L’Etat la société civil et le secteur privé, et l’activation de ces mécanismes exiges des capacités institutionnelles pour garantir l’amélioration de la prestation de services, son activation exige également la capacité à respecter et à recourir à des principes de bonne gouvernance.
décentralisation, ainsi elle œuvre à changer la réalité structurelle et une contribution sérieuse dans le déclanchement de la transformation politique et sociale de la société.
Etant donné que dans ce cadre elle va au-delà de la formulation d’un système juridique solide et globale, qui va mettre en place des institutions appropriées et capables de mettre en œuvre ces droits.
