Executi-ve Secretary's reservations concerning the propriety

of _resolution 242(XJT

Before resolution 242(Xl) was adopted, the Executive Secretary drew the atxention of the Conference to the impropriety of the draft resolution and, in particular, of operative paragraph 4»

The Executive Secretary referred the Conference to certain provisions of _ the United Nations Charter7 the terms of reference of the Commission and its

rules of procedure. Commission resolution l88(lX) setting out the functions of

the Executive Committee and the Staff Rules and Regulations of the United

Nations, He explained that all staff of the United Nations; including those'

of the Commission, were governed by the United Nations Staff Regulations, which were established by .the General Assembly in pursuance of Article 101 of"

the Charter, and that questions relating to the staff and administration of^ ■

the United Nations Secretariat fell within the purview'of the competent bodies .of the United Nations, namely the General Assembly and the Fifth Committee*

The Executive Secretary therefore advised against the adoption of the draft resolution and indicated that, in the event that it was adopted by the , Conference, he would seek confirmation of his interpretation of the United NationG Rules and Regulations from the Office of Personnel Services and the Office of Legal Affairs at Headquarters. This was done and the two,Offices' confirmed the impropriety of the resolution and, in particular,■ of operative paragraph 4. The Executive Secretary therefore recommends that, in taking

action on Part IV of the report, the Council should decide to refer, resolution

242(Xl) back to the Conference of Ministers.
