Call for papers

Mediation and Conciliation : new approaches, new challenges ?

Workshop on October 7 - 10 , 2016, Rabat (Morocco)

The figures of mediators and conciliators have been given extensive consideration within classical anthropological research on conflict and dispute resolution (Nader & Todd 1978, Gulliver 1979, Abel 1982, Greenhouse 1985). The increasing emphasis on the international human rights framework and actors (NGOs, United Nations) to take part in conflict resolution and judicial systems strrenghtening as well as the involvement of new actors and institutions in the area of mediation (for instance the médiateurs de la République in France) has possibly re- shaped and transformed existing paradigms, norms and practices of conflict/dispute resolution.

This workshop proposes to explore the inter-related elements between different forms and configurations of various justice systems and judicial institutions through two modes of dispute resolution, namely mediation and conciliation. Through the review of relevant anthropological literature and on-going ethnographic research, we invite fellow anthropologists and social scientists to reflect on new and emerging methods of mediation and conciliation, and we are particularly interested in:

(i) Research that examines social representations of local justice (institutions and actors) from a historical and anthropological perspective,

(ii) Research that showcases the participation of NGOs and UN actors in the establishment and operationalization of formal justice systems and dispute resolution mechanisms at the local or national level (Nader 1990, Dupret 1999, Drieskens 2006, Nieuwenhuys, 2001).

(iii) Fieldwork that documents key moments of the dispute resolution process from the referral to a mediator or conciliator to the stage of final decision-making and case resolution.

While we are primarily interested in fieldwork that highlights European, Mediterranean, North and Sub-Saharan African legal and judicial contexts, we are also keen on broadening the proposed socio-cultural and geographical scope. We invite submissions from researchers working on different legal traditions (Roman law, Common law, Islamic law, customary law, plural legal system, etc.) and on various legal institutions where those resolution practices may take place (judicial or religious institutions, private or more formal settings).

Calendar and application process

We invite interested candidates to submit an abstract of their presentation, in French or English, to mlantin@ehess.fr, aidasdiop@gmail.com and yazid.ben-hounet@ehess.fr. The abstract will clearly state the candidate’s full name, their affiliated academic institution and their title (academic status) and the title of the proposed presentation. The summary should not exceed 500 words.

The workshop will take place in Rabat between 7 and 10 October 2016. The deadline for submission is 28 January 2016 and notifications of acceptation to the workshop will be communicated no later than 15 March 2016. Final presentations will need to be submitted by 20 August 2016.

While French will be the preferred language of communication for the workshop, candidates will also have the opportunity to express themselves in English.
