Number 307 Thursday, 22 December 2011 Sec. III Page 140341 III OTHER PROVISIONS

AUTONOMOUS COMMUNITY OF CASTILE-LEON

20012 Agreement 221/2011, of 24 November of the Council of Castile-León, declaring falconry in Castile and León, as a property of intangible cultural interest.

Falconry, a living and human cultural heritage recognised by UNESCO as an Intangible Cultural Heritage of Humanity, is the traditional practice of breeding and training falcons or other birds of prey to take quarry in its natural state. With more than four thousand years of history, this activity, transmitted from generation to generation, has been and continues to be recognized and practiced throughout the Community of Castile and León and has had a significant influence on all areas of the life and culture of our society.

The Directorate General of Cultural Heritage, by a Decision taken on 6 July 2009, agreed to initiate proceedings for declaring Falconry in Castile and León, a Cultural Heritage of an intangible nature.

In accordance with the provisions of article 11.2 of Law 12/2002, of 11 July, on the Cultural Heritage of Castile-León, and article 42 of the Regulations for the Protection of the Cultural Heritage of Castile-León, approved by Decree 37/2007, of 19 April, the University of Valladolid and the University of Salamanca, reported favorably on the draft declaration.

Having completed the mandatory public information procedure within the period granted for that purpose, no allegations have been presented.

In accordance with the requirements of article 12.1 of Law 12/2002, of 11 July on the Cultural Heritage of Castile-León, and in article 46.3 the Regulations for the Protection of the Cultural Heritage of Castile-León, approved by Decree 37/2007, of 19 April, the Councillor of Culture and Tourism has proposed declaring Falconry in Castile-León, an intangible Property of Cultural Interest and, to this end, it has been stated that the mandatory procedures have been

completed to open and manage a file. An excerpt from said file containing the necessary information for the declaration and the corresponding graphic documentation is attached.

On this basis, the Council of Castile-León, following a proposal of the Councillor for Culture and Tourism, and a discussion of the Governing Council at its meeting on 24 November 2011, adopts the following agreement:

To declare Falconry in Castile-León, an intangible Property of Cultural Interest.

Against this Agreement, which brings the administrative route to an end, an internal

administrative appeal may be brought before the Council of Castile-León within one month, or, within two months, a direct administrative appeal before the Administrative Chamber of the

High Court of Justice of Castile-León. Both deadlines will be counted from the day following the date of its publication in the "Official Journal of Castile-León". If an internal administrative appeal is to be brought, no other administrative appeal may be brought until there is an express or presumed decision on the former.

Valladolid, 24 November 2011.

The Chair of the Council of Castile-León, Juan Vicente Herrera Campo.

The Director of Culture and Tourism, Alicia Garcia Rodriguez.
