A P P E N D I X

THE ALBERTA UNIFORM BUILDING STANDARDS ACT THE ALBERTA BUILDING REGULATIONS

1. Subject to variations specified in the Schedule hereto, Parts 1, 2, 3, 4, 5, 6, 7, 8 and 9 of the National

Building Code of Canada 1970 (document No. N.R.C. 11246 published by the National Research Council, Ottawa) including amendments and revisions as published by the

National Research Council, Ottawa, in "Errata" and Revisions to the National Building Code of Canada 1970, Change Series No. 1, 2 and 3 are hereby declared to be in force under the Alberta Uniform Building Standards Act.

2. Where the term "by-law" is used in the National Building Code i t shall be deemed to mean these regulations.

3. This regulation comes into force on April 1, 1974.

S C H E D U L E

The National Building Code of Canada 1970 issued by the

Associate Committee on the National Building Code, including amendments and revisions as published by the National

Research Council, Ottawa, in "Errata" and :Revisions to the National Building Code of Canada 1970, Change Series No. 1, 2 and 3, is hereby amended:

1. Part 1 Administration is deleted and replaced with: "PART l ADMINISTRATION

SECTION 1.1 SHORT TITLE

SUBSECTION 1.1.1. These Regulations may be cited as "The Alberta Building Regulations".

SECTION 1.2 PURPOSE

SUBSECTION 1.2.1. It is the purpose of these Regulations to safeguard life or limb, health, property and public welfare with r~spect to the design, construction and alteration of buildings by the provision of appropriate minimum standards. SECTION 1.3 SCOPE

SUBSECTION 1.3.1. Parts 1, 2, 5, 7 and 8 of these Regulations apply to all buildings.

SUBSECTION 1.3.2. Parts 3, 4, and 6 of these Regulations apply to:

(a) all buildings used for Assembly~ Institutional, and High Hazard Industrial Occupancies,

(b) all buildings exceeding 6000 square feet (558 square meters) in building area or exceeding 3 storeys in building height used for Residential, Business and Personal Services, Mercantile and Medium and Low Hazard Industrial Occupancies.

-SUBSECTION 1.3.3. Part 9 of these Regulations applies to

buildings 3 storeys or less in height, having a building area not exceeding 6000 square feet (558 square meters) and

which are used for Residential, Business and Personal

Service, Mercantile, and Medium and Low Hazard Industrial Occupancies.

SUBSECTION 1.3.4. These Regulations do not apply to farm

buildings other than those used as residences.

SUBSECTION 1.3.5. These regulations do not apply to

factory construction of mobile homes constructed prior to

January 1, 1975.

SECTION 1.4 APPLICATION

SUBSECTION 1.4.1. The application of these Regulations

shall be in accordance with Subsections 1.4.2 to 1.4.7

inclusive, subject in every case to the overall limitations

set out in Section 1.3.

SUBSECTION 1.4.2. When a building is built, these

Regulations apply to the design and construction of the

building.

SUBSECTION 1.4.3. · When the whole or any part of a building

is demolished these Regulations apply to any part remaining

which becomes unsafe as a result thereof and to the work

involved in the demolition.

SUBSECTION 1.4.4. When the whole of any part of a building

is moved to a new site or into the province these

Regulations apply to all parts of the building.

SUBSECTION 1.4.5. When a building is altered these

Regulations apply to all parts of the building affected by

the alterations.

SUBSECTION 1.4.6. When the occupancy of a building is

changed these Regulations apply to all parts of the building

affected by the change.

SUBSECTION 1.4.7. When materials and equipment regulated by

these Regulations are replaced or altered in a building

these Regulations apply to all such replacements and

-SECTION 1.6 REFEHENCED DOCUMENTS

SUBSECTION 1.6.1. When.detailed technical information regarding materials, equipment and methods of structural design is necessary to ensure their compliance with the performance requirements of these Regulations reference is made in the text to the specific edition of an appropriate technical standard issued by a recognized standards

organization. These Regulations therefore include as part of their provisions these referenced documents to the extent that they relate to buildings.

SUBSECTION 1.6.2. In the case of any conflict between the provisions of these Regulations and those of any.reference document the provisions of these Regulations- will· always take precedence.

NOTE: Supplements 2, 3, 4 and 5 of the National Building Code of Canada contain technical information that will assist in the effective use of these

Regulations but they do not constitute a part of these Regulations.

SECTION 1. 10 RESPONSIBILITY OF THE OWNER

SUBSECTION L 10 .1. Neither the granting of a permit nor the approval of the drawings and specifications nor inspections made by the authority having jurisdiction shall in any way· relieve the owner of such building from full responsibility for carrying out the work or having the work carried out in accordance with the requirements of these Regulations.

SECTION 1.11 DUTIES OF THE OWNER

SUBSECTION 1.11.1. Every owner of property shall:

{a) permit the authority having jurisdiction to enter any building or premises at any reasonable time for the purpose of administering or enforcing these Regulations;

{b) obtain, where applicable, from the appropriate authority having jurisdiction, permits relating to building, zoning, grades, sewers, water mains, plumbing, signs, blasting, street occupancy,

electricity, highways, occupancy and change in the class of occupancy, and all other permits required

-SUBSECTION 1.11.2. Where tests of any materials are made to ensure conformity with the requirement of these

Regulations, records of the test results shall be kept available for inspection during the construction of the buil,.ding.

SECTION 1.13 EQUIVALENTS

SUBSECTION 1.13.~. The provisions of these Regulations are not intended to limit the appropriate use of materials, equipment or methods of construction not specifically authorized herein. Any owner desirous of providing

equivalent materials, equipment or methods of construction shall submit to the authority having jurisdiction sufficient evidence to ensure that the proposed equivalent will provide the level of performance required by these Regulations.

SECTION .1.14 TESTS

SUBSECTION 1.14.1. To the extent that is possible all tests required by the authority having jurisdiction shall be

carried out in accordance with recognized standard test methods. In the absence o~ such standard test methods the authority having jurisdiction may specify the test procedure to be followed. Copies of the results of all such tests shall be retained by the authority having jurisdiction after construct'ion is complete and shall form part of the public records.

SECTION 1.15 APPEALS

SUBSECTION 1.15.1. Appeals are to be processed under the provisions of The Alberta Uniform Building Standards Act. SECTION 1.18 CLIIVl..ATIC DATA

SUBSECTION 1.18.1.When climatic data are required for the design of buildings in this province, they shall be the data in Supplement #1 "Climatic Information for Building Design in Canada" published by the Associate Committee of the National Building Code of Canada~ If climatic data is unavailable from Supplement #1 or from a recognized

-SECTION 1.19 OTHER PP.OVINCIAL FEGULATIONS

SUBSECTION 1.19.1. Alberta Regulations covering building services have been adopted under the following Acts:

SECTION 1.20

"Boiler and Pressure Vessels Act; Electrical Protection Act;

Elevator and Fixed Conveyafices Act; Fire Prevention Act;

Gas Protection Act;

Workers' Compensation Act;'.

PREPARATION OF PLANS AND SPECIFICATIONS AND INSPECTION OF CONSTRUCTION

SUBSECTION 1.20.1. In addition to the requirements of the Alberta Architects' Act and the Engineering and Related Professions Act, whenever, in the opinion of the authority having jurisdiction, the construction of a proposed building requires architectural or engineering skill or knowledge, then the plans and specifications shall be prepared and signed by an Architect or Professional Engineer Registered or Licensed in Alberta, and, if deemed necessary by the

authority having jurisdiction an Architect or a Professional Engineer registered or licensed in the Province of Alberta

shall provide for appropriate inspections of.such a building for compliance with The lUberta Building Regulation~"

2. Part 2 DEFINITIONS is amended:

(a) by striking out the following:

"appropriate authority having jurisdiction means the departments of the provincial governments and agents thereof that have authority over the subject that is regulated'

and by substituting therefore the following:

"appropriate authority having jurisdiction means authority having jurisdiction by legislation over the subject matters that are regulated." and

council and the agent thereof that have authority over the subject that is regulated"

3. Part 3 USE AND OCCUPANCY is amended as follows:

3.2.7.3. Washroom facilities in buildings falling within articles 3.2.7.1 or 3.2.7.2 shall conform to Article 3.6.4.5. (Where

buildings are designed to

accommodate handicapped persons, the requirements in NBC

Supplement No. 5, 'Building Standards for the Handicapped, 1970', may be used as a guide.)" 3.2.7.4. Except by special permission, where permanent housing projects are funded in part or in whole by the

Government of Alberta, every project of 50 dwelling units or over shall contain dwelling units designed for the handicapped, in conformance with NBC Supplement No. 5. The number of such units to be provided shall be as

follows:

Project of 50 - 100 units provide 1 unit for the handicapped. Project of 100 - 200 units provide 2 units for the handicapped. Project of 200 and over units provide 3 units for the handicapped.

138 3.6.4 Add new Article as follows: "3.6.4.5. In every building falling within articles 3.2.7.1 or 3.2.7.2 where washrooms are provided for the public, at least one washroom shall be provided that is designed for and is accessible to physically handicapped persons in

-4. Part 6 BUILDING SERVICES is amended as follows:

Natural and Mechanical

Ventilation 62-73."

Add sentence (4) as follows: "Air contaminants shall be

restricted to values established

by the Workers' Compensation Act

covering 'Safety Regulations

Governing Ventilation and Control of Gases, Vapours, Mists~ Fumes, Smoke and Dust'."

Change article 6.2.3.2 to

6.2.3.2(1) and add sentence (2) as follows:

"Heating design temperatures

shall be based on Chart 2. 1%

basis, January Design temperatures of Supplement #1 to the National Building Code of Canada 1970

covering Climatic Information

for Building Design in Canada.

Minimum acceptable wind

velocities for design of heating

systems shall be 15 miles per

Add the following words: "or in accordance with

appropriate manual issued by the Sheet Metal and Air Conditioning Contractors National Association Inc."

Add the following words: "and to 90A-1973."

Add the following words: "as outlined in subsection 9.34.6 of these regulations." Add the following words:

"Ducts in or under slab on grade shall be of metal and of gauges recommended by ASHRAE or SMACNA and they shall be encased in a minimum of 2" of concrete. Where perimeter warm air ducts are installed in or under slab within 3' of grade level a minimum of one inch (l") rigid insulation with a K value of not less than 0.3 shall be installed between the duct and outside footing."

Add sentence (8) as follows: "All clothes dryer vents shall be ducted to the outside. Where dryers are collectively vented a sheet metal duct shall be

provided and a continuously operating fan positioned up stream from all outlets to positively exhaust all moisture

and lint. Screens on this type

of installation shall be deleted.

Suitable access doors shall be

installed for cleaning purposes. A dryer vent shall not be

connected to any other exhaust system."

Add the following words:

"The outdoor air intake opening shall be not less than ten feet from the discharge outlet of any

exhaust fan. Unless adequate

means is provided for the removal of dust from the air, the bottom of the opening shall be not less than 10 feet above the surface of any abutting public way, gangway, driveway,

or grade."

Delete and replace with:

"Exterior openings for outdoor air intakes and exhaust outlets shall be shielded from the entry of snow and rain and shall be fitted with corrosion-resistant screens of mesh not larger than 1/2 inch for exhaust outlets, 1 inch for intakes and for combustion air intakes in accordance with the applicable

CSA Installation Code~ except

where climatid conditions may

require larger openings. Such

Add article (d) .as follows: "a thermal sensor to provide an alarm if fire migrates along the feed tube to the fuel storage bin."

Add the following words:

"The automatic control of every system or device for the burning of pulverized fuel shall be in accordance with requirements of NFPA 60-1961."

Aqd Subsection 6.2.9 SUBSECTION 6.2.9 DIRECT FIRED MAKE-UP AIR HEATERS

6.2.9.1(1) Where installed these units are not intended to supply any of the regular

heating requirements of the space into which they discharge; separate space heating equipment shall be available for this purpose.

6.2.9.1(2) The burners shall be of adequate size to temper the outside air from the winter design conditions as outlined under section 6.2.3.2 to a minimum discharge temperature

suitable for the occupancy of the building. The installation of a make-up air heater shall not reduce the capability of a heating system to meet the minimum heating design requirements of a building.

6.2.9.1(3) The unit shall be capable of operating without heating for summer ventilation. 6.2.9.1(4) The air supplied by the unit shall not exceed by more than 10% the amount of air being exhausted mechanically from the space in which the unit is installed.

6.2.9.1(5) Both exhaust and supply fans shall be interlocked and operating before burner

ignition is possible.

6.2.9.1(6) All air before passing through or over burners shall be filtered to prevent leaves, papers or other objects from being picked up from the outside, ignited and dis9harged.

Filters may be removed for winter operation.

6.2.9.1(7) The connection between the outside air intake and the unit should be in a straight line. If this is not possible, proper turning vanes shall be used so that the air is evenly distributed across the face of the combustion area and to prevent stratification.

5. Part 7 is hereby deleted and replaced with the following: SUBSECTION 7.1.1.

Every plumbi ng system shall conform to the "Regulations

Governing Plumbing and Drainage" as adopt~d under Alberta

To be changed to 9.34.2.6(1) and change in third last line

"(2) Each dwelling unit of a multiple dwelling shall have thermostatic control of its own heat supply."

Delete words "need not" in last line and replace with word

"shall".
