6.11 P RIORITY OF D OCUMENTS

If there is a discrepancy between the wording of any documents that appear on the list, the wording of the document that first appears on the list has priority over the wording of any document that subsequently appears on the list.

6.13 Dispute Resolution

(a) The parties agree to maintain open and honest communication about the Work throughout and after the performance of the contract.

(b) The parties agree to consult and co-operate with each other in the furtherance of the contract and promptly notify the other party or parties and attempt to resolve problems or differences that may arise.

(c) If the parties cannot resolve a dispute through consultation and cooperation, the parties agree to consult a neutral third party offering alternative dispute resolution services to attempt to address the dispute.

(d) Options of alternative dispute resolution services can be found on Canada’s Buy and Sell website under the heading “Dispute Resolution”.

1 Introduction

The Canadian Forces School of Military Engineering (CFSME) has a requirement to procure seven (7) new heavy/ severe excavator digging buckets, ten (10) replacement shanks and twenty (20) replacement teeth to be used for training purposes.

2 Background

CFSME’s Heavy Equipment Troop runs the Heavy Equipment Operators Course (HEOC) in a remote area within the 5th Canadian Division Support Base (5 CDSB) Gagetown Range Training Area (RTA). CFSME utilizes seven (7) Department of National Defence (DND) owned

excavators in support of HEOC training, the cueenrt buckets require replacement due to wear form normal use.

3 Objective

CFSME requires a contractor to provide seven (7) heavy/severe excavator digging buckets, ten (10) replacement shanks and twenty (20) replacement teeth for use with Volvo EC220D excavators.

4 Deliverables

4.1 The Contractor shall provide seven (7) new excavator buckets meeting the following specifications:

4.1.1 Heavy/severe duty excavator digging bucket made from high-strength, abrasion-resistant steel, 1.25 cubic yard (+/- 0.05 cubic yard) in size.

4.1.2 42” (+/- 1”) wide with 5 teeth.

4.1.3 Teeth must be suitable for heavy digging of hard ground (rock tooth).

4.1.4 Shanks (adaptors) and teeth must be attached to bucket at time of delivery. Shanks can be either bolted or welded on to the bucket.

4.1.5 Buckets must be compatible with the Volvo quick disconnect system SQF1 (code: 11796, part# 14616184).

4.1.6 If required, two (2) pins, compatible with both bucket and quick disconnect system.

4.2 The Contractor shall provide replacement shanks and teeth as follows:

4.2.1 10 replacement shanks, compatible with the proposed bucket. Shanks must include all bolts/pins/fasteners if they apply.

5 DND Support

5.1 CFSME heavy equipment coordinator will install buckets at delivery location.

5.2 CFSME will ensure the unloading of equipment at the time of delivery, and provide any necessary equipment not listed in this SOR.

6 Constraints

6.1 All products must be fabricated and manufactured from new materials, free of defects, complying with applicable codes and industry standards, in accordance with this SOR and accompanying contract documents.

6.2 All products must have at a minimum one (1) year standard parts and manufacturer’s defects warranty.

7 Transportation

7.1 The Contractor is responsible for all transportation costs as they apply, for the delivery of the equipment.

7.2 Delivery can be made Monday to Friday, between 0800hrs and 1600hrs, to Lavina Wood located in the Range Training Area. (Grid 19T FL 98818 714938).

7.3 The Contractor must contact the Technical Authority two (2) business days prior to delivery in order to make the appropriate arrangements for access to the Range Training Area.

Bids MUST meet the mandatory requirements specified below. To demonstrate that all requirements of the technical specifications are respected bidders MUST respond with complete specifications and/or descriptive literature of the equipment being offered.

The complete specifications and/or descriptive literature should be submitted with the proposal but may be submitted afterwards. If the complete specifications and/or descriptive literature are not submitted as requested, the Contracting Authority will so inform the Bidder and provide the Bidder with a time frame within which to meet this requirement. Failure to comply with the request of the Contracting Authority and to meet the requirement within that time period will render the bid non-responsive.

Any proposal which fails to meet all mandatory requirements will be deemed non-responsive. Each requirement should be addressed separately.
