DRAFT INTERN:TIONAL SANITARY REGULATIONS Comments by the Government of Ireland

Definitions;-

It is suggested that the definition of approved port be altered to mean

"a port at which is available the equipment and personnel necessary for the derat-.

ting of vessels". Such equipment is npt possessed by some port authorities in this country but arrangements are made with qualified firms to carry out derattifcg.

I f this suggestion is accepted eonsequemtial amendment of Article 1 4 ( l ) b would be necessary.

This Department is advised that the International Telecommunications Union is the only body competent to deeide whether telegrams originating from the WHO may be treated as Government telegrams. It is assumed that the Organization has taken steps to clarify with the Union the position regarding the treatment of such telegrams. The extension to include the specialized agencies of the category of bodies entitled to send Government telegrams is not favoured by the postal authorities of this country.

Article 2

It is again suggested that the existence of a foyer of smallpox should be compulsorily notifiable.

Article 8

It is suggested that, instead of the action required by the second sentence of this Article, it would suffice i f national health administrations notified annually to the Organization the changes which had occurred since their

immunization requirements were last published. It is considered that an annual recapitulation of all measures in force imposes on member states and on the Organization an unnecessary burden, and it is hoped that this Article w i l l be

4 amended to obviate this. This would be without prejudice to the notifications called for by the first sentence of the A r t i c l e .

Article 13 (e)

It is not considered necessary that arrangements for immediate vaccination against cholera and yellow fever should be available at all tines at all

sanitary ports and airports. In some areas such vaccinations are very seldom administered and in such cases it would suffice i f the arrangements were such that vaccination against cholera and yellow fever, could be made available within a few hours.

Articles 2 8 ( 3 ) and 39î

It is suggested that these Articles be altered so as to permit the reception of food and stores in addition to fuel and water»

Article 46

This country is in agreement with the advice given to the Legal Sub- committee on this paragraph and considers that any necessary amendment of the Article should be made to give effect to the advice.

Article 75

The advice given to the Legal Sub-Committee, should, it is suggested, be adopted. Health authorities should have power to place people under surveillance even though they have been vaccinated and they may also in certain circumstances require isolation until the result of the vaccination is known* It is suggested that paragraph 2 of this Article should be altered to make it clear that sub- mission to vaccination does not absolve from isolation a person coming from an infected area i f the health authority considers this necessary,

Article 8 4 ( 1 ) ( a )

It is suggested that this be altered to read "disinsecting and isolation or surveillance". This is suggested to cover the case of a person suspected to have typhus who is proceeding to an area which is known to be infested. In such an area he might pick up lice and i f typhus then developed the lice would become infected and could easily cause an epidemic» The case might not arise very often but it is considered that the health authority should have the necessary power to cope with it»

Article 91

It is again suggested that provision might be made for signature of the aircraft Declaration of Health by an authorized agent. The F.A»L* General

Declaration may be signed by an authorized agent and unless provision is made for

which is delivered to the health authority to be signed specially by the pilot in charge of an aircraft. I f an authorized agent's signature were generally accepted the right of calling upon the pilot in special circumstances might be retained»

Article 93

It is noted that the terms of this Article preclude the further use of the personal Declaration of Origin and Health, It is suggested that further consider- ation should be given to this matter« The form, as recently amended, provides in a clear and concise format, the information which health control staff require to enable them to clear transit and disembarking passengers with the ainiinum of delayH

In the absence of the form the required information can only be elicited by questioning the passengers, a procedure which would obviously lengthen the time required to clear them through health controlo The alternative to questioning transit passengers, in the absence of the form, is to dispense with health control measures for them. In the Minister's opinion this would be unsound since an

infected transit passenger could transmit the infection for example to members of the airport staff with whom he comes in contact and thus the fact that his stay is

normally short can only be regarded as a limiting factor in regard to the number of contacts,he can make. Having regard to these considerations it is suggested that the retention of the personal Declaration, which does net take more than a few moments to complete and therefore imposes very little burden on passengers, would be in the best interests of both health control staff and airline passengers»

Article 98

At present there is an arrangement between this country and Great Britain under which air and sea traffic between the two countries is not normally subject to any measures of sanitary control. I t is not quite clear, in view of the fact that the special arrangements between neighbouring countries may be concluded

" i n order to make the sanitary measures provided for in these Regulations more efficacious and less burdensome" that this arrangement can be continued when the new Regulations come into force. I f Article 98, as at present drafted, does in fact permit the continuance of this arrangement it is acceptable to this country., I f not i t is suggested that the Article be amended so as to make continuance of these arrangements possible without this country having to make a reservation in connexion with the Regulations,
