LEGAL
&
DISTRIBUTIONAL
CONDITIONS
:
This License Agreement concerns Lexical Items as registered in the Focal
Vocabulary Index of Studio for Propositional Cinema, and outlines the legal
and procedural conditions regarding their transfer and use. Legal possession
of such documents acknowledge a binding sole license agreement between
the Licensee and Studio for Propositional Cinema, in perpetuity, and grants
the Licensee full rights for the use and display of the Item(s) thereof. Studio
for Propositional Cinema retain rights for all future use and display of these
Items, within an agreement to publicly acknowledge the Licensee upon
each occasion. The Focal Vocabulary Index consists exclusively of Lexical
Items used by Studio for Propositional Cinema for the construction of works,
performances, and exhibitions since 2013, and will accrue all future Items
used in such a manner.
1. General Description
Studio for Propositional Cinema’s Focal Vocabulary Index (see 1.1) is an
inventory (see 1.2) of all Lexical Items (words, compound-words, punctuation,
etc.) that have been used as tools for the construction of works publicly
disseminated by Studio for Propositional Cinema since their inauguration in
2013 (see 1.3).
As we exist in a material reality shaped by the contingency of external
elements affecting the connections between them, each individual Item is
organized into one of three categories: Concrete, Conditional, and
Connective (see 1.4).
2. Terms of License
Each individual item within this Index is subject to a co-licensing agreement
between Studio for Propositional Cinema and a second party Licensee, with a
contractual agreement permitting the Licensee to use and display the Lexical
Item(s) in exchange for an agreed one-time fee (which may be monetary or an
alternate mode of exchange).
Concrete and Conditional Items are subject to an exclusive license, whereas
Connective Items are non-exclusive and can be acquired only within larger
Lexical Structures constructed with Concrete and/or Conditional Items, in
order to bind them for use within a mutually agreed linguistic structure
(see 2.1).
Each License is produced as a offset prints on US Legal sized paper and
includes the name of the Item and its License Agreement. Three copies of
each document are printed: one for the record of the Licensee acquiring the
item, one for the record of the Licensor (Studio for Propositional Cinema), and
one for the record of the brokering party. The printing plate used to produce
the License is the property of the Licensee, and is considered the publicly
displayable index signifying the transaction.
3. Title Protocol
When an agreement is publicly exhibited by the Licensee, Studio for
Propositional Cinema must be credited as the author of the work see 3.1). If
multiple Items are acquired to construct Lexical Structures, each Item shall
be listed in the order in which it appears, preceded by the title of the Lexical
Structure (see 3.2).
If a licensed Item is used in a public display by Studio for Propositional Cinema,
the Licensee shall be acknowledged as a lender to the exhibition in the form
of a wall label, printed document, and/or on the website of the hosting body,
within the standard courtesy protocols of the individual institution or exhibiting
body (see 3.3).
If a licensed Item is used in another artwork produced by Studio for
Propositional Cinema, the Licensee must be acknowledged in perpetuity in
the material description connected to the title of the work (see 3.4). This
also applies if this work is acquired by a third party. The Licensee has no
physical or intellectual claim of ownership to works in which their licensed
Item has been used, but their participation in the material construction of such
works shall be acknowledged in perpetuity.
4. Extended Use and Transfer
The Licensee may be an individual, a group of individuals, or a trust, institution,
estate, or corporation.
The License Agreement may be transferred from the Licensee to a third party.
It is the responsibility of the Licensee and/or third party to inform Studio for
Propositional Cinema as to any change of custody. This is necessary for any
changes in credit information (notwithstanding unknowable developments,
retroactive credit changes are not material-temporally possible).
Studio for Propositional Cinema may not produce further works that extend
the License Agreements of any licensed Lexical Items to any third parties.
Further Lexical Items will be added to the Index as they are used to construct
new works. All Lexical Items existing or inventible within the communicational
world are potential materials with which to construct descriptions of or
Endnotes
1.1.
In the field of anthropology, the term ‘focal vocabulary’ is used to
describe a set of terms used within an individual language to describe the
same object, activity, or phenomenon, especially one that is of heightened
importance within an individual culture or group. Traditionally used to
describe multiple articulations of one thing, Studio for Propositional Cinema
has “borrowed” or “misappropriated” this term to describe a broader approach
to an entire linguistic system, with each word categorized into one aspect of
the world and/or culture in which we exist, with each constituting the contexts
in which we see and are seen.
1.2.
Each Lexical Item has been catalogued with a chronological inventory
number marking the year of first use, an index to the occasion on which it first
appeared, and order of appearance therein.
1.3.
Studio for Propositional Cinema was inaugurated on June 8, 2013 at
the Kunstverein für die Rheinlande und Westfalen with a speech claiming that
“the vocabulary that we have inherited is imprecise and the old definitions are
constantly shifting. We do not want to propose new or more accurate terms.
We thrive in the ambiguity of their language because it is a space of freedom.”
1.4.
Concrete units denote elements of the given quantities of the
material reality of human experience. This category includes units such
as “GASOLINE”, “CINEMATOGRAPHY”, and “TENDERNESS”.
Conditional units denote the conditions within which the concrete elements
operate and which affect our perception of and operation within them. This
category includes units such as “HYPOTHETICAL”, “BUREAUCRACY”,
and “PUBLISHING”. Connective units are those that allow us to link the
Conditional and Concrete elements in order to articulate the relationships
between them and between them and ourselves. This category includes units
such as “INTO”, “&”, and “THEREFORE”.
2.1.
Lexical Structures (works consisting of multiple Lexical Items) may be
constructed by Studio for Propositional Cinema, by a third party at the request
of Studio for Propositional Cinema, or suggested by a third party (i.e. Licensee)
to Studio for Propositional Cinema (subject to approval). All individual Items,
when available, are acquirable without the approval of Studio for Propositional
Cinema.
