The Government of Mongolia views decentralisation and democratisation as key reforms to ensure more efficient and inclusive development. Authorities are committed to increasing civic engagement - a fundamental component of good local governance - decentralising power and improving government accountability. SDC’s Civic Engagement Project (CEP) reaffirms Switzerland’s support to Mongolia in strengthening the legislative framework for citizens’ participation in decision-making and public affairs.

Direct democracy and citizens’ participation are not new to Mongolia. According to the 1992 Constitution, “the people shall exercise state power through their direct participation in state affairs as well as through the representative bodies of state power elected by them”. In 1995, the Law on Referendum established top-down national referendums - an element of direct democracy. However, the direct participation of citizens in decision-making processes was low-key. Since 2011, Mongolia has placed renewed emphasis on direct democracy and citizens’ participation in public affairs, primarily at the prompting of President Ts. Elbegdorj. and adoption of such laws as the Integrated Budget Law, the General Administrative Law, the Law on Legislation and the Law on Public Hearing. In addition, Citizens’ Halls are being established throughout the nation to serve as venues for dialogue and discussion. Despite the progress that has been made, a number of challenges remain, including incoherent and ineffective implementation of those laws, and a lack of information and knowledge among citizens about the laws and their rights. The right to initiate a referendum is currently limited to the Parliament, government and President. However, Mongolia favours a bottom-up approach to referendums, giving people the right to make decisions independently at the time of their choosing.

activities and expected results legal and regulatory framework: The project will support the establishment of a coherent and empowering legal and regulatory framework for citizens’ participation in public affairs. This will be achieved with the participation of, and input from, a range of key stakeholders, including the government, civil society organisations and citizens. This framework will reflect and bolster the key aspects of civic engagement, including bottom-up referendums, Citizens’ Assemblies and Halls, public hearings on local government affairs, and local government financial accountability.

including women, youth, vulnerable groups and people in remote areas via a comprehensive communications strategy. assessment and learning: Periodic assessment of the progress of citizen engagement will help to determine the impact of civic engagement policies and participatory mechanisms, and will enable further streamlining and refining of efforts. Best practices at the sub-national, national and international levels will be shared.

international exchange: International exchange visits and peer-learning events will be organized in order to share Mongolia’s knowledge and experiences in civic engagement with other countries.
