Objet : Communication dans l’affaire MANZANAS MARTIN c/ Espagne (Requête n° 17966/10), arrêts du 3/04/2012, définitif le 3/07/2012 et du 5/03/2013, définitif.
Monsieur le Directeur Général,
Lors de nos précédentes communications, nous vous avons signalé la situation critique des pasteurs espagnols qui se retrouvent dans le même cas que dans l’affaire Manzanas Martin c/ Espagne, dans laquelle la Cour des Droits de l’Homme s’est prononcée en 2012.
Conformément aux articles 9 § 2 et 9 § 3 des Règles du Comité des Ministres pour la surveillance de l’exécution des arrêts et des termes des règlements amiables, nous voudrions vous informer que nos communications concernant les mesures générales restent toujours d’actualité et présentent toujours un caractère d’urgence.
Tout d’abord, il convient de signaler que le Décret Royal, promis par le gouvernement pour la fin juin, a été adopté le 21 septembre dernier, publié au Bulletin Officiel de l’Etat en date du 22 septembre avec un effet rétroactif au 1
erjanvier 2015. Il a été adopté malgré un avis négatif de la Commission Consultative sur la Liberté Religieuse du Ministère de la Justice et une forte opposition de la FEREDE quant à son contenu.
En dépit de l’adoption de ce Décret Royal, la situation des pasteurs intéressés ne va, semble-t-il, pas
s’améliorer. En effet, d’après les analyses faites par les juristes de la FEREDE et de notre Eglise
membre, le décret paraît trop restrictif et pose des conditions qui ont pour effet de laisser la plupart
des pasteurs concernés en dehors de son champ d’application. A supposer que cette norme ait dû
s’appliquer au défunt Pasteur Manzanas, il n’aurait pas eu droit à la pension de retraite étant donné

qu’il ne remplissait pas toutes les conditions posées. Cette solution n’est pas adaptée aux pasteurs en question. Ainsi, l’Eglise Protestante Espagnole va intenter un recours devant les tribunaux contre ce Décret Royal.
Nous nous préoccupons vivement de cette situation et pensons qu’il est impératif de trouver une solution adéquate aux problèmes auxquels les pasteurs concernés font face.

MANZANAS MARTIN vs Spain

Dear Mrs. Mayer,
I write to you answering your letter of 27 October 2015, in which you convey to us the com- munication put forward by the CEC (European Conference of Churches) according to article 9.2 and 9.3. of the Rules governing the supervision of execution of judgments of the ECtHR. This communi- cation comments the general measures that may derive from the final ECtHR judgment in the above referred case.
Concerning your offer to formulate our comments on those of the CEC, we would like to re- mind here the content of our previous letters of 29 may 2014 and 8 September of 2014.
In addition to them, we are glad to inform you that in the Spanish Official Bulletin of 22 Sep- tember 2015 the Royal Decree 839/2015, of 21
stSeptember, modifying the conditions of integration in the Spanish Social Security System of the priests of the churches integrated in the FEDERE (Fed- eration of Evangelic Religious Entities of Spain) has been published. It produces full retroactive ef- fects as to the first January 2015.
This Royal Decree entails the full equivalent treatment of evangelic priests to that offered to catholic priests by the first Transitional provision of Ministerial Order of 19 December 1977.
This is precisely what the ECtHR judgment refers to in its § 54.
As evangelic priest, unlike catholic priests, might be married, pensions for family members are also regulated.
The estimated financial cost of the application of this Royal Decree for the Spanish Social Security amounts to 16.400.000 €.
Every evangelic priest or member of his family who may benefit from this Royal Decree will
generate the following average individual cost: 130.600 € for every retirement pension granted,
207.000 € for every permanent incapacity pension granted and 107.000 € for every other type of
pensions (mainly in favor of the family in case of death).

It is not accurate to say that the Consultative Commission on Freedom of Religion did not back the project of Royal Decree in the meeting held the 29 May 2015. After careful consideration of its contents and casting votes of the members of the Commission, the project was finally approved.
As already informed, Mr. Manzanas received his just satisfaction in due time. The cases that may prove to be similar to that of Mr. Manzanas Martin fall under the scope of application of this new Royal Decree.
We are respectful of the right of any group or individual concerned to challenge the Royal Decree before the Spanish Courts of Justice. Spain considers that the Royal Decree is in conformity with national and international law and respectful of the criteria set by the ECtHR judgment.
We respectfully beg the distribution of this letter, together with our previous letters of 29 may 2014 and 8 September of 2014, to all Delegations in response to the last comment of the CEC.
I render at your disposal should you require further information concerning this case.
Our Action Report on this case will follow immediately.
