The Twenty- eighth World Health Assembly

1. NOTES the status, as at 30 April 1975, of the collection of annual contributions and of advances to the Working Capital Fund, as reported by the Director -General;

2. CALLS THE ATTENTION of Members to the importance of paying their annual contributions as early as possible in the Organization's financial year, in order that the approved annual programme can be carried out as planned;

3. URGES Members in arrears to make special efforts to liquidate their arrears during 1975; and

4. REQUESTS the Director -General to communicate this resolution to Members in arrears and to draw their attention to the fact that continued delay in payment could have serious financial implications for the Organization.

The Twenty- eighth World Health Assembly,

Having considered the proposals of the Director- General and the recommendations of the Executive Board concerning the supplementary estimates for 1975 to meet unforeseen additional costs relating to increases in the salaries and allowances for professional and higher categories of staff, approved by the General Assembly of the United Nations with effect from 1 January 1975; and

Considering that it is desirable to avoid the need for additional contributions by Members for the 1975 budget to finance these supplementary estimates,

1. APPROVES the supplementary estimates for 1975; and

2. DECIDES to amend the Appropriation Resolution for the financial year 1975 (resolution WHA27.56) by (1) increasing the relevant appropriation sections by the following amounts:

(Committee B, first report) WHA28.9 Salaries and allowances for ungraded posts

The Twenty- eighth World Health Assembly,

Noting the recommendations of the Executive Board with regard to remuneration of staff in the un- graded posts,

1. CONCURS in the recommendations of the Board; and, in consequence,

2. ESTABLISHES the salary for the post of Deputy Director- General at US $60 050 before staff assessment, resulting in a revised net salary of US $36 625 per annum;

3. ESTABLISHES the salary for the posts of Assistant Directors - General and Regional Directors at US $53 250 before staff assessment, resulting in a revised net salary of US $33 225;

4. NOTES that, concurrent with the revision of salary rates for these officials, appropriate revision will be made of the post adjustment rates applicable to these posts; and

5. DECIDES that these adjustments in remuneration shall be effective from 1 January 1975.

(Committee B, first report) WHA28.10 Salary of the Director -General

The Twenty- eighth World Health Assembly

1. AUTHORIZES the President of the World Health Assembly to sign an amendment to the contract of the Director -General to establish the salary of the Director -General at US $74 800 per annum before staff assessment, US $44 000 per annum net after staff assessment; and

2. DECIDES that, since the revision of salary scales has effect from 1 January 1975, this change shall also be effective from that date.

WHA28.11 Assessment for 1975 of Botswana The Twenty- eighth World Health Assembly,

Noting that Botswana, a Member of the United Nations, became a Member of the World Health Organization by depositing with the Secretary -General of the United Nations a formal instrument of acceptance of the WHO Constitution on 26 February 1975;

Recalling that the Twenty -sixth World Health Assembly, in resolution WHA26.21, affirmed its belief that the scale of assessment in WHO should follow as closely as possible that of the United Nations;

Noting that the General Assembly of the United Nations, in resolution 3062 (XXVIII), established the assessment of Botswana for 1974, 1975 and 1976 at 0.02 %;

Recalling that the Twenty- second World Health Assembly, in resolution WHA22.6, decided that from 1968 new Members shall be assessed in accordance with the practice followed by the United Nations in assessing new Members for their year of admission;

DECIDES

(1) that Botswana shall be assessed for 1975 at the rate of 0.02 %;

(2) that the assessment for 1975 shall be reduced to one -third of 0.02 %.

WHA28.12 Assessment for 1974 and future years of Grenada The Twenty- eighth World Health Assembly,

Noting that Grenada, a Member of the United Nations, became a Member of the World Health Organi- zation by depositing with the Secretary -General of the United Nations a formal instrument of acceptance of the WHO Constitution on 4 December 1974;

Recalling that the Twenty- second World Health Assembly, in resolution WHA22.6, decided that from 1968 new Members shall be assessed in accordance with the practice followed by the United Nations in assessing new Members for their year of admission;

DECIDES

(1) that Grenada shall be assessed for 1974 and future years at a rate to be fixed by the World Health Assembly, as and when the assessment rate for this country has been established by the General Assembly of the United Nations;

(2) that Grenada shall be assessed at the provisional rates of 0.04 % for 1974 and 0.02 % for 1975 and future years, to be adjusted to the definitive assessment rate when established by the World Health Assembly; and further

(3) that the assessment for 1974 shall be reduced to one -ninth of 0.04 %.

Noting the admission of Tonga to membership in the Organization on 14 May 1975;

WHA28.18 Members in arrears in the payment of their contributions to an extent which may invoke Article 7 of the Constitution

The Twenty- eighth World Health Assembly,

Having considered the report of the Ad Hoc Committee of the Executive Board 1 on Members in arrears in the payment of their contributions to an extent which may invoke the provisions of Article 7 of the Constitution;

Having noted that Bolivia, the Dominican Republic, El Salvador, Haiti and Paraguay are in arrears to such an extent that it is necessary for the Assembly to consider, in accordance with Article 7 of the Constitution, whether or not the voting privileges of these Members should be suspended;

Noting that Bolivia, El Salvador, Haiti and Paraguay have made payments in 1975;

Noting further the proposals made by Paraguay for the settlement of its outstanding contributions; 2 Recognizing the efforts made by those four countries to liquidate their arrears; and

Noting that the Dominican Republic has made no payment to the Organization in respect of its assessed contributions since 1966, in spite of the acceptance by the Twenty -fifth World Health Assembly of its proposal for settlement of its arrears, and that, as a result, the Dominican Republic is in arrears for the balance of its

1965 contribution and for the full contributions for the years 1966 to 1974,

1. DECIDES not to suspend the voting privileges of Bolivia, El Salvador, Haiti and Paraguay at the Twenty - eighth World Health Assembly;

2. ACCEPTS the settlement of its arrears proposed by Paraguay, to the effect that the consolidated outstanding contributions for the years 1972 -1975 be paid in 10 equal instalments of US $13 650 in the years 1976 -1985;

3. DECIDES that if the arrangements specified in operative paragraph 2 above are fulfilled by Paraguay it will be unnecessary for future Assemblies to invoke the provisions of paragraph 2 of resolution WHA8.13 and that, notwithstanding the provisions of Financial Regulation 5.6, payments of contributions of Paraguay for the year 1976 and future years shall be credited to the year concerned;

4. URGES Bolivia, El Salvador, Haiti and Paraguay to intensify the efforts now being made in order to achieve at the earliest possible date the regularization of their position;

5. DECIDES to suspend the voting privileges of the Dominican Republic at the Twenty- eighth World Health Assembly;

6. URGES the Dominican Republic to regularize its position at an early date and to implement the arrange- ments for settlement of its arrears accepted by the Twenty -fifth World Health Assembly, thus enabling the Dominican Republic to resume its full participation in the work of the World Health Assembly; and

7. REQUESTS the Director -General to communicate this resolution to the Members concerned.

WHA28.19 Procedure for election of six Members entitled to designate a person to serve on the Executive Board The Twenty -eighth World Health Assembly,

Considering that the Secretary -General of the United Nations on 21 May 1975 has notified the Director - General of the entry -into -force of the amendments to Articles 24 and 25 of the Constitution, adopted by the Twentieth World Health Assembly and increasing the number of Members entitled to designate a person to serve on the Executive Board from 24 to 30,

DECIDES that the election of a further six Members to be entitled to designate a person to serve on the Executive Board shall take place at its present session and that the following procedures shall be applied for this election:

(1) The Health Assembly shall elect a further six Members entitled to designate persons to serve on the Executive Board. Of those Members elected, two shall serve for a period of three years, two for a period of two years and two for a period of one year, as determined by lot by the President of the Health Assembly immediately after the election has been completed.

(2) The election of the six Members shall take place in accordance with Rules 97 to 100 of the Rules of Procedure of the Health Assembly, provided that:

(a) the General Committee shall nominate and draw up a list of nine Members, recommending in such list the six Members which, in the Committee's opinion, would provide, if elected, a balanced distribution of the Board as a whole;

(b) the Health Assembly shall elect by secret ballot, from among the Members so nominated, the further six Members to be entitled to designate persons to serve on the Board, as in (1) above.

The Twenty- eighth World Health Assembly,

Considering that, in accordance with Financial Regulation 5.5, "Annual contributions and advances to the Working Capital Fund shall be assessed in US dollars, and shall be paid in either US dollars or Swiss francs; provided that payment of the whole or part of these contributions may be made in such other currency or currencies as the Director -General, in consultation with the Board, shall have determined ";

Recalling resolution WHA2.58 of the Second World Health Assembly, which established the principle that all Member governments shall have equal rights in paying a proportionate share of their contribution in such currencies as may be acceptable;

Taking into account resolution EB39.R30 as well as earlier resolutions of the World Health Assembly and the Executive Board on the currencies of payment of contributions;

Noting that the Working Group on Currency Instability established by the General Assembly of the United Nations has found no generally agreed alternatives to policies already being utilized in the United Nations and related agencies in order to solve the problems faced by the organizations as a result of con- tinuing currency instability and inflation,

1. DECIDES that the present arrangements for payment of contributions in currencies other than US dollars or Swiss francs, as established in resolution EB39.R30, should be continued; and

2. REQUESTS the Director -General to continue to collaborate as appropriate in any future interorganizational studies or consultations concerning possible solutions to the budgetary problems resulting from currency instability and to report thereon to the Executive Board and the Health Assembly.

Noting with satisfaction that the Director -General has made arrangements to provide the WHO headquarters services with the premises they will need in 1975 and 1976 by renting offices in the new ILO headquarters building;

Considering it desirable that the Organization should have its own premises so as to ensure that the offices required by it after that period will be available;

Recognizing that in present economic conditions the resources for financing a large architect -designed building are lacking; and

Noting that the cost of a smaller prefabricated building that would contain about 138 standard offices and have a useful life of at least 20 years before requiring major repairs is estimated at Sw. fr. 5 630 000, I. AUTHORIZES the Director -General to pay from the Casual Income Account the rent and the cleaning, maintenance and installation costs of the offices rented by WHO in the ILO building until 31 December 1976, up to the extent of the amount accruing to WHO from the sale by ILO of its temporary building in Petit

Saconnex;

2. FURTHER DEFERS a decision on the construction of an architect- designed extension to the headquarters building;

3. AUTHORIZES the construction of a new prefabricated building containing about 138 offices on the site belonging to the Organization; and

4. AUTHORIZES, to finance in part the construction of this prefabricated building, the use of the reserves that have accumulated in the Real Estate Fund for the construction of a larger architect -designed extension to the headquarters building.

WHA28.25 Review of the Working Capital Fund The Twenty- eighth World Health Assembly,

Having considered the recommendations of the Executive Board on the Working Capital Fund, A

1. DECIDES that:

(1) Part I of the Working Capital Fund, composed of advances assessed on Members and Associate Members, shall be established in the amount of US $5 114 000, to which shall be added the assessments of any Members or Associate Members joining the Organization after 30 September 1974;

(2) the advances to the Working Capital Fund shall be assessed on the basis of the 1976 scale of assess- ment, adjusted to the nearest US $10;

(3) any additional advances shall be due and payable on 1 January 1976; and

(4) any credits due to Members and Associate Members shall be refunded on 1 January 1976 by applying these credits to any contributions outstanding on that date or to the 1976 assessments;

2. REQUESTS the Members and Associate Members concerned to provide in their national budgets for payment of the additional advances on the due date;

B

I. DECIDES that Part II of the Working Capital Fund shall remain established at US $6 000 000;

2. DECIDES also that Part II of the Working Capital Fund shall be financed by appropriations by the Health Assembly from casual income as recommended by the Executive Board after considering the report of the Director -General; such appropriations shall be voted separately from the appropriations for the relevant budget year;

1. AUTHORIZES the Director -General to advance from the Working Capital Fund:

(1) such funds as may be required to finance the appropriations pending receipt of contributions from Members and Associate Members; sums so advanced shall be reimbursed to the Working Capital Fund as contributions become available;

(2) such sums as may be required during a calendar year to meet unforeseen or extraordinary expenses, and to increase the relevant appropriation sections accordingly, provided that not more than US $250 000 are used for such purposes, except that with the prior concurrence of the Executive Board a total of US $2 000 000 may be used; and

(3) such sums as may be required for the provision of emergency supplies to Members and Associate Members on a reimbursable basis; sums so advanced shall be reimbursed to the Working Capital Fund when payments are received, provided that the total amount so withdrawn shall not exceed US $200 000 at any one time, and provided further that the credit extended to any one Member or Associate Member shall not exceed US $50 000 at any one time; and

2. REQUESTS the Director -General to report annually to the Health Assembly:

(1) all advances made under the authority vested in him to meet unforeseen or extraordinary expenses and the circumstances relating thereto, and to make provision in the estimates for the reimbursement of the Working Capital Fund, except when such advances are recoverable from other sources; and (2) all advances made under the authority of paragraph C 1 (3) for the provision of emergency supplies to Members and Associate Members, together with the status of reimbursement by those concerned;

D

REQUESTS the Director -General to continue his efforts to secure early payment of Members' and Associate Members' annual contributions, in order to preclude the necessity of increasing the amount of the Working Capital Fund;

E

REQUESTS the Director -General to submit a report on the Working Capital Fund to the Executive Board and the World Health Assembly when he considers it warranted, and in any case not less frequently than every third year.

2. NOTES with appreciation its findings, conclusions and recommendations, and in particular the necessity of an integrated approach to the development of the Organization's programmes, all programme activities at all levels being mutually supportive and parts of a whole;

3. STRESSES the importance of programme planning being viewed as a joint endeavour in which national authorities, WHO representatives, regional committees, regional offices, the Executive Board, the World Health Assembly and WHO headquarters should all be involved;

4. URGES that the Organization's mechanism for the allocation and reallocation of resources, not only within programmes and regions, but also between programmes and regions, should comply with the principle of responding to integrated programme planning; and

WHA28.31 Organizational study on the planning for and impact of extrabudgetary resources on WHO's programmes and policy

The Twenty- eighth World Health Assembly, Recalling resolution WHA27.19;

Having considered the recommendation made by the Executive Board in its resolution EB55.R42,

1. DECIDES that the study on the planning for and impact of extrabudgetary resources on WHO's programmes and policy should be continued for another year; and

2. REQUESTS the Executive Board to report on its study to the Twenty -ninth World Health Assembly.

WHA28.32 Future organizational study by the Executive Board The Twenty- eighth World Health Assembly,

Recalling its resolution WHA28.31, by which it was decided that the study on the planning for and impact of extrabudgetary resources on WHO's programmes and policy should be continued for another year;

Bearing in mind resolution WHA9.30, in which the Health Assembly found it desirable that the subject for organizational study should be selected at least a year in advance;

Taking into account resolution EB55.R44,

DECIDES to await the recommendation of the Executive Board at its fifty- seventh session on the selection of a subject for a future organizational study and to refer the question to the Twenty -ninth World Health Assembly.

WHA28.33 Use of Chinese as a working language of the World Health Assembly and the Executive Board 1 The Twenty- eighth World Health Assembly,

Noting that the Chinese language is an official and working language of the United Nations;

Noting further that the Chinese language is an official language of the Health Assembly, the Executive Board and the Western Pacific Regional Committee of this Organization;

Believing that the use of the Chinese language as a working language of this Organization will contribute to the work of the Organization,

DECIDES to

(1) request the Director -General to prepare a comprehensive study on the progressive implementation of the Chinese language as a working language of the World Health Assembly and the Executive Board for the consideration of the Executive Board at its fifty- seventh session; and

(2) further request the Director -General to submit his study together with the comments of the Executive Board to the Twenty -ninth World Health Assembly.

WHA28.34 Use of Arabic as a working language of the World Health Assembly and the Executive Board The Twenty- eighth World Health Assembly,

Recognizing the significant role of the Arabic language in preserving and disseminating the civilization of man and his culture, and its influence on the progress of medicine and science;

Recognizing further that the Arabic language is the language of twenty Member States of the World Health Organization, and is a working language in the United Nations, UNESCO, the Organization of African Unity, in the Regional Office for the Eastern Mediterranean of the World Health Organization and

several other international organizations and unions;

Aware of the need to achieve greater international cooperation and more universality of the World Health Organization;

Noting with appreciation the assurances of the Arab States Members of the World Health Organization to meet collectively the expenses of implementing this resolution during the first three years,

DECIDES to include the Arabic language among the working languages of the World Health Organization, so as to be used in the World Health Assembly, the Executive Board, the main and subcommittees, and to be used for correspondence with Arab countries as a regular procedure; and to amend accordingly the relevant provisions of the Rules of Procedure.

WHA28.35 Health assistance to refugees and displaced persons in the Middle East The Twenty- eighth World Health Assembly,

Recalling resolution WHA27.42 on the health conditions of the refugees and displaced persons in the Middle East as well as the population of the occupied territories,

A

Having considered the Director -General's report on the health assistance to refugees and displaced persons in the Middle East;

Mindful of the principle that the health of all peoples is fundamental to the attainment of peace and security;

Considering that Israel's deliberate destruction and devastation of refugee camps, cities and towns, such as the destruction by Israel of the town of Quneitra, gravely affect the physical and mental health of their inhabitants;

Deeply alarmed by the deterioration of health and living conditions of the Palestinian refugees, the dis- placed persons and the population of the occupied territories,

1. CALLS UPON Israel to immediately implement the relevant United Nations and World Health Assembly resolutions calling for the immediate return of the Palestinian refugees and displaced persons to their homes as well as the full implementation of the Fourth Geneva Convention Relative to the Protection of Civilian Persons in Time of War, of August 1949;

2. REQUESTS the Director -General to allocate appropriate funds to be devoted to the improvement of the health conditions of the population in the occupied Arab territories; and

3. FURTHER REQUESTS the Director -General to ensure that the above -mentioned funds be spent under the direct supervision of WHO and through the provision of its representatives in the occupied Arab territories;

Bearing in mind resolution WHA26.56, which established the Special Committee of Experts to study the health conditions of the inhabitants of the occupied territories in the Middle East;

Having received the report of the Special Committee and noting from its content that the Committee was refused, once again, to visit the Arab territories under Israeli occupation;

Aware of resolution WHA24.33 and the relevant provisions of the Constitution of WHO concerning the failure of Members to meet their obligations to the Organization,
